““The next step: Perry should REFUSE to allow the IRS to collect the Obamacare tax in Texas.”

By refusing to implement a state exchange, Texas may well have made the employer mandate (a penalty or tax of 3,000 per employee if the employer does not provide health insurance or if an employee decides not to use an employer’s health insurance) unenforceable in Texas. It will take litigation to prove the point. But it could be a winner.”

I think you dream of a just federal employees in blackrobes. As John Roberts continues to demonstrate such uncorrupted men are rare and far between on the Federal bench.

It is nonetheless a wonderful dream.

Is it a slam dunk? No. But the feds are aware of the problem and the IRS has tried to give itself authority to enforce the employer mandate by regulation. That’s a pretty thin argument. The rats goofed on the statute and did not authorize enforcement unless there is a state exchange. Normally, it would be fixed by mop up legislation. But no way they get that thru congress now.
