I’m not sure this lady would need the castle dotrine to justify this shooting. I’m a prosecutor and a judge (Harvard educated but raised in Montana) once told me that most all defenses to criminal prosecutions are grounded in necessity. The test is “was it reasonable and was it necessary?”. The inquiry should end there.

Then maybe you would know the answer to this: how would I go about challenging the legitimacy of a state statute for violating the state’s own constitution? From asking around, it seems like I have to actually get myself charged with violating the statute in order to gain any standing... and that just seems wrong.
