Pardon me for the dumb question.

I know why she does not want to go to a Grand Jury, but how
does she get away with not going to the Grand Jury? It
would seem to me that it is required under the 5th Amendment.

Something about not being held to answer for a capital or
otherwise infamous crime without...

just asking.

what they said on Fox news was grand jury is only required for 1st deg murder. I think prosecutor can use grand jury in other charges but is not required

There’s no capital punishment for 2nd degree murder. The crime may be “infamous,” but not necessarily in the way the Constitution means.
