Court's Obama order a 'hissy fit'

(CNN) The Fifth Circuit's homework assignment to the Department of Justice is a disgrace -- an embarrassment to the federal judiciary. Still, it's a useful window on the contemporary merger of law and politics.

This is not judging. This is a judicial hissy fit. The Supreme Court will determine the constitutionality of the health care law, and the president will, as he must, abide by that judgment whether he agrees with it or not. In the meantime, however, the president, like all Americans, enjoys the right to express himself on what the court should do in that or any other case.

With its petulant order to the Justice Department, the Republican judges performed a peculiar, if useful, kind of service to the public -- reminding us of the partisan nature of much of the federal judiciary. The Supreme Court's decision in the health care case may offer a similar lesson.

The above Jeffrey Toobin who is lecturing us fly-over country rubes is the same media elite legal snob who was hauled into court by Yale-educated lawyer, Casey Greenfield, who said he's the father of her child. Toobin, 52, is a married man.

She's the daughter of another media elite, Jeff Greenfield, chief political correspondent for CBS Evening News and another inescapable leftist TV pundit know-it-all.

The old (and tired) argument that Obama is just a regular guy.

No, Toobin, Obama is the President and THE key defender of the Constitution (remember that oath thingy he took on January 20, 2009?).

He is NOT "like all Americans". We will make him "like all Americans" on January 20, 2013. But until then, he has to be a leader with big Constitutional responsibilities. And he cannot make irresponsible public statements to express himself.

What sort of disingenuous claptrap is this? The President is not like every other powerless American and when he speaks it is with the threat of the force he can bring to bear.

Tobin needs to be taken to the woodshed.

The left is digging that hole so deep now that while it soothes the illiterati in their base, the rest of the country sees the implied threat and consequent attempts at coverup.

For my part, I say keep it up. Keep talking. I’m really pleased. Keep exposing yourselves because at this point, it is obvious.

But apparently "that right to express himself" doesn't extend to the Fifth Circuit, douchebag? er, Toobin?

Look, Jeffy's mad because Sam & Nino have decided to draw a line in the sand on the Commerce Clause and limit its heretofore unregulated powers. That means a lot of planned Leftist garbage will never pass muster.

I’ve seen this Toobin guy’s mentioned before. I have no idea who he is, but from what I’ve read it seems his comprehension of reality is severely lacking. Can people with this sort of disordered thinking actually possess any marketable skills?

I’m torn.

As an attorney, I do think that this is a ridiculous abuse of discretion by a judge and there is no way on earth I would ever actually respond to it.

On the other hand, it’s kind of funny.

The problem is that they have acted and he ignores it if he doesn't like it. A poster above already mentioned the drilling moratorium case.

The president represents the executive branch of government. Most other Americans, do not.

If tax dollars pay even one dime for the teleprompter and podium he uses to speak, or the gas to get him there, he is speaking for the branch, and not just for himself.
