Nothing wrong going on here. The only error on the judge’s part is that she chose an inappropriate time to receive oral arguments.

Code you cited indicates that they have to be in the driver's seat to be "in control"; but the story says that they were found together in the back seat.
You may argue about how they got there, but it looks to me like the officer can't charge her for being drunk in the back seat.
Wait until the cop shows the judge his cell phone pics.

Check out poster 3 and the judge was drunk but the DA is GUILTY as charged {including any future charges}.

The story mentions that the car was running (keys in the ignition) with its headlights on. It was approx. 1:45AM.
