If the answer to that is 'yes', then articles of impeachment can and should be brought forth.
With regard to the recess appointments, the answer is "no." The Constitution provides for impeachment for treason, bribery, high crimes, and misdemeanors. The Constitution permits recess appointments and nothing in the Constitution defines the word "recess." The fact that O'Dumbo has violated a Senate Rule or handshake understanding handed down from prior administrations, does not make the recess appointments an impeachable offense.
Ask yourself this: Focusing on this one issue, if a Republican president had done the same thing, would you be calling for impeachment? Of course not. We would be celebrating the fact that we have finally have a republican president with the balls to stand up to the obstructionist RATs in the Senate.
BTW -- I don't think any of the pundits have applied the "recess clause" in Art. II §2(3)of the Constitution correctly. That provision gives the POTUS the power to "fill up all Vacancies that may happen during the Recess of the Senate." THe language is straight and simple: The vacancy itself must occur when the Senate is in recess. If the Seante is in session when the vacancy occurs, then the POTUS has no right to a recess appointment.
This resident has been banging on the Constitution from day one. Granted, he sees the the Constitutional damage of the last 80 years and wants to pile on a bit himself. But the problem is he is going for the final nails right under our eyes. The House should have dozens of ongoing investigations beyond F&F at this point. And a new one should be drawing up articles of impeachment that do have muster - that’s not my job, that’s theirs. If they look back over 3 years and cannot find any, so be it. But, they are NOT even trying, all the while our republic is being sunk by nefarious skunks.
