Occupy protesters sue over free speech, force

Most major Occupy encampments have been dispersed, but they live on in a flurry of lawsuits in which protesters are asserting their constitutional rights to free speech and assembly and challenging authorities' mass arrests and use of force to break up tent cities.

Lawyers representing protesters have filed lawsuits — or are planning them — in state and federal courts from coast to coast, challenging eviction orders and what they call heavy-handed police tactics and the banning of demonstrators from public properties.

Some say the fundamental right of protest has been criminalized in places, with protesters facing arrest and charges while doing nothing more than exercising protected rights to demonstrate.

"When I think about the tents as an expression of the First Amendment here, I compare it to Tahrir Square in Egypt," said Carol Sobel, co-chairwoman of the National Lawyers Guild's Mass Defense Committee.

The left wields the court like a weapon, using the judicial branch to sue to get around the other branches of government, and get their way. The pescedents and rulings set by the judicial branch are useless if the other two branches won’t enforce them. Call it selective enforcement.

Closing businesses, raping, and murdering? Drug use?

As much as I can’t stand these fithly miscreants, and realize that they would happily take away the rights of others through any means possible, I would like to know just where does one hold an extended protest?

We all say that the Tea Party “did it right”, and they did. Got the permits, held the rally, etc. But when did ones right to public redress become contingent upon permits? What if they decline the permit? Can I protest the town hall without one? Will I be arrested?

The way I see it, so long as they are on public property, they have a right to thier silly protest, and we hae a right to mock them. Of course these clowns took it too far in many cases. They blocked businesses, lived like pigs, etc. Actual infringment on the rights of others should be prosecuted, but legitimate protests, no matter how misguided, should never be curbed by the government.

The next Tea Party rally could be denied it’s permit by a leftist town hall somewhere, and OWS will justifiably stand there and laugh at us.

How long does a demonstration have to go on before it becomes something else?

I am quite sure that one day is short enough that there won’t be any question, but thirty days or more is no demonstration; it is trespass.

Good argument. Maybe this whole thing was just a ruse to keep legitimate protests quiet or better yet illegal. Remember, these pigs got paid to stay there by leftist organizations.

Then again, maybe my tinfoil hat needs loosening or NOT!

The cities should counter sue for the costs of clean ups, police overtime past a certain point, etc. And seeing how a lot of the Occupiers are trust fund babies they should have deep pockets.

And they got pilloried for it and was forced to pay money that Occupy got away without paying.

The only way to beat liberals are to hit them over the nose with a newspaper and send them back under the porch whimpering.

Didn’t Reagan teach us anything about how to fight the left?

Yes sue back. Start with personally suing these lawyers and their pathetic lawsuits.

No one was barred from demonstrating, but there is a difference between demonstrating and setting up camp.

If they wish to set up camp they should rent a farmers field, not interfere with public property. Not to mention the damages.
