Sandusky's lawyer expects more charges

The preliminary hearing of accused child molester Jerry Sandusky was pushed back Tuesday, while his attorney expressed concern about possible new charges and jail time for the former Penn State assistant coach.

Sandusky, who is charged in a 40-count indictment of sexually assaulting eight boys over a period of 15 years, will appear in court Dec. 13.

The 67-year-old former Penn State defensive coordinator was initially scheduled to appear before a judge Nov. 9, but that was moved to Dec. 7 earlier this month.

News of the delay came as Sandusky's attorney Joseph Amendola admitted to ABC News on Tuesday that he anticipated more charges to be filed against his client in December, which could lead to jail time, pending a full trial.

Why is there any question about jail time? If he is guilty he should rot in prison.

I think what he is saying is that he is concerned about the bail being revoked because of new charges. I assume they have been concerned about “jail time” from the start, if convicted.

That judge is very experienced and sounds like a real straight arrow, intolerant of corruption. Just what this case needs.

I hope this is an untainted judge. I am concerned about the prosecution. Are they strong enough? Serious enough? (Or tiwll then play Marcia Clark and Darden roles). It took them too many years to file charges. One prosecutor went the way of Jimmy Hoffa. Another thing is the red-headed graduate assistant (McQueary) who just could not keep his mouth shut and had to go to media and send an “off record” e-mail to “a friend”. He has jeopardized the perjury charges against Spanier and Curly which are based on McQueary “telling them what he saw” in the shower with the coach and the kid. Those 2 higher-up denied before the grand jury ever hearing any explicit details, so the perjury charges on the 2 men are based primarily on McQueary’s word. But he then says in his e-mail that he told the police (what?) and the relevant police forces immediately deny he reported anything to them. It was so gratuitous. Creates a ton of “reasonable doubt” due to his diminished credibility. Thank goodness other kids have come forward. If Sandusky chooses to go to the mat, Penn State will be as annihalated as the Catholic Church was over their own child sex scandal.

The judge was or is chairman of the state commission investigating the "kids for cash" scandal that sent two judges to prison. This is part of his initial statement:

"Our concern, however, is not only the action of two Luzerne County judges. Our concern is also the inaction of others. Inaction by judges, prosecutors, public defenders, the defense bar, public officials and private citizens -- those who knew but failed to speak; those who saw but failed to act.
Our concern is also the inaction of those who would have acted but did not have the tools needed to assess the information that might have been an early warning of the system’s breakdown.
All of those involved -- whether by action, inaction or silence -- whether by willful choice or benign ignorance -- engaged in an assault on the fairness and impartiality of our legal system. It was an assault on the very rule of law. This is a serious matter indeed, because an attack on the rule of law is an attack on democracy itself. The sense of community that underlies democratic government is sustained by the sure faith that law will be applied uniformly and fairly, without fear or favor, or corruption."

I think they got the right guy.

It's Schultz and Curley who were charged. To the best of my knowledge Spanier has not. I always thought the perjury charges were a stretch because Paterno sounded squishy about just what he told them.

I agree McQuaery is an idiot and has endangered the case against them. He has done himself no credit in this whole sorry affair.

Lib, I’m all for putting Sandusck in the general population of any really nasty federal pen !

OTOH, I’d want a lot of the “movers and shakers” in the PSU “Trustee Club” to share the same fate !

No way anyone can convince me the PSUBOT hadn’t intimate knowledge of a scandal over a decade old ! Sandusky was “passed over” for a job he was a shoo in.....Why ? Failing that a lot of schools were searching for a head coach, but he didn’t get a nod...again Why ? And, finally, WHY did Sandusky “retire” at the apex of his collegiate coaching career ?

And the PSUBOT is going to plead “ignorance” to all of this !!!!? >PS

Thanks for correction. The red head’s credibility is gone. The perjury charges are probably gone along with it (in the absence of other strong evidence). Sandusky’s lawyers also seems to be steering towards a circus (ala OJ’s trial). Next we have to hope for a decent jury panel.

It would not surprise me if venue is changed because it would just not be possible to get an impartial jury in that county.
