The Fifth Amendment says all sorts of things but it specifically exempts the military in a combat situation from having to adhere to it.

End of story.

Usually once people read through and think about what the Fifth actually says they come around to the position that it was not only OK to shoot Alwaki with a cruise missile, he could have been nuked!

I'd like to see that used on the next puke.

Where exactly is the exemption you speak of written in the 5th Amendmennt?

I’ve read it many times and never noticed any exemption. Can you provide a source or link for your silly statement?

Here’s the entire 5th Amendment:

No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.[1]

There’s no exemption allowing the President to order the killing of an American citizen in there. Awlacki wasn’t a member of the US military so the “land and naval forces” clause doesn’t apply to him.

Nice try.

“The Fifth Amendment says all sorts of things but it specifically exempts the military in a combat situation from having to adhere to it.”

yes:

“except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger..”

POTUS is the Commander of the armed services. This is a time of War or public danger. POTUS gave the order.

case closed.
