U.S. Asks Court to Block Alabama’s Harsh Immigration Law (Enforcing law now equals "harsh")

President Barack Obama’s administration filed a motion Friday asking a federal appellate court to block implementation of Alabama’s tough new immigration law, citing a risk the measure will lead to discrimination.

Justice Department attorneys want the 11th Circuit U.S. Court of Appeals in Atlanta to impose an injunction against enforcement of H.B. 56 pending a final ruling on the multiple suits challenging its constitutionality.

Critics call the Alabama measure the most extreme of the five state laws that have been adopted recently to combat illegal immigration.

The Justice Department said Tuesday that for the federal government the priority in applying immigration laws is the detention of foreigners who represent a threat to national security or who have committed crimes.

“States do not have the authority to disregard these priorities and create a patchwork of independent immigration policies. Similarly, neither the Constitution nor the federal immigration laws permit a state scheme avowedly designed to drive aliens out of the State – a program of de facto removal,” the federal brief says.

H.B. 56 requires state and local police to ask people they suspect of being undocumented for proof of legal residence, and forces public schools to verify the immigration status of new students.

Late last month, U.S. District Judge Sharon Lovelace Blackburn barred the state government from enforcing four of the clauses contained in the law, but allowed other elements of the legislation to stand.

The Justice Department and other plaintiffs asked Lovelace meanwhile to withhold the application of the law until a ruling is handed down on the multiple suits challenging its constitutionality.

On Wednesday Lovelace dismissed that request and said the government had not shown that the application of the law would cause significant harm to the public interest.

“Although it is too soon to determine with precision the effects of H.B. 56, news accounts confirm that the law is having its intended but impermissible consequences of driving aliens from the State,” the Justice Department said Friday.

H.B. 56 likewise appears to be “inducing many parents to keep their children home from school due to fear about the State’s immigration policy,” the federal filing said.

I’m sure a Constitutional scholar could easily clarify this, but how does “establish an uniform Rule of Naturalization” give the feds the power to block any state’s right to protect itself against invasion?

I’m undoubtedly missing something important here, but I fail to see where the rules of naturalization extend in any way to people sneaking across the border. LEGAL aliens are not the same as ILLEGAL aliens.

They just caught a child sex offender for sexual abuse of a child under the age of 12. Thanks to the new law he cannot make bail and skip town.
