Fired dwarf settles with Starbucks for $75K

Starbucks has settled a suit for $75,000 with a woman who claimed she was fired because she is a dwarf.

According to Reuters, Elsa Sallard, a barista at a store in El Paso, TX, requested a stool or small stepladder to do her job. Starbucks denied the request and fired her that same day in 2009. The company said she could have been a danger to employees and customers.

The U.S. Equal Employment Opportunity Commission, which filed the lawsuit in May, said after three days of training, the store should have made a reasonable accommodation for the woman.

Robert Canino, an attorney with the commission, told Reuters the settlement sends the right message from Starbucks corporate.

Starbucks plans to provide training on disability issues to managers and supervisors at its El Paso stores.

Well...it depends on the method of the firing....

we talking about compressed air.....propane....black powder.....?

was there a safety harness provided....crash helmet....goggles.....?

Only if the employer fails to make "reasonable" accommodation.

She thought that adding stools and step ladders to the narrow confines of a crowded area behind the coffee bar was reasonable.

Starbucks looked at the trip and fall hazards and said no.

The court looked for the deep pockets, and said yes.

Starbucks hired her for the job knowing how tall she was; why shouldn’t they be required to follow through, or pay a penalty?
