LITTLE ROCK, AR (KAIT) The Arkansas State Police Trooper involved in a fatal accident in Manila has once again been reinstated to the force.
The appeals court just came down with the decision.
Lawyers for Andrew Rhew argued his firing was unjustified, because the victim in the accident was to blame.
According to Robert Newcomb, attorney for Andrew Rhew, say Vicki Freemyer was going at least 8 mile per hour, if not more, going through a stop sign.
Freemyer was killed in the September 2009 accident. According to police Rhew was southbound on Highway 77 when his marked patrol car and Freemyer's vehicle collided. Police determined Rhew was speeding and not running his siren or flashing lights at the time of the accident.
Newcomb also claims that the initial report from the state crime lab indicated that Freemyer's drug levels were such that she was moderately impaired.
Rhew was fired in December, but reinstated in March after his attorney argued no decision on his employment should be made until after his criminal trial.
Rhew pleaded no contest to a negligent homicide charge in April, and then fired again in June. On Thursday afternoon he was once again reinstated to the ASP force.
He didn’t shoot or run over a pet dog so he’s cool with me.
As a practical matter, traffic laws do not apply to the police, nor do most other minor laws. They don’t apply, because they simply aren’t enforced against them.
I get passed by patrol cars on a regular basis going 20-30 mph over the speed limit (no lights, no siren), and they are constantly drifting lanes with their heads turned 90 degrees and down, reading their laptops.
If we want honest police, we shouldn’t allow them to be above the law, any law.
They really use the ASP acronym?

I do also here in Florida so I usually follow at the same speed havent been pulled over yet.
No, they don't call it "asp" as in a venomous snake. Just A. S. P.
He must be a friend of Bill Clinton.
