Man, 29, charged with manslaughter after intruder shot, leaves blood trail on street before dying in

The man, 34, was shot in the leg with a vintage Luger pistol after a struggle with the homeowner at Silvereye Circuit in Gilston in the Gold Coast Hinterland in the early hours of Tuesday morning.

Sources say the 29-year-old homeowner told police he arrived home about 1.40am to be confronted by four masked men inside the house.

He told police he wrestled with one of the intruders and the gun discharged, the bullet hitting the man's femoral artery.

Bleeding profusely, he staggered outside and into the street where he dropped dead, leaving a 50m blood trail in his wake.

This afternoon, police charged the homeowner with manslaughter. He is expected to face Southport Magistrates Court tomorrow morning.

Sources said drugs were believed to be at the centre of the shooting and the four men who took part in the home invasion had travelled up from Sydney.

Earlier, Gold Coast police regional crime co-ordinator Tim Trezise said said the spate of gun crimes on the Gold Coast, including the fatal shooting in May of police officer Damian Leeding, was upsetting the community and putting pressure on police.

"It continues to be a concern to police and the whole community in relation to firearm offences and offences of this ilk," he said.

"We've had a number of these offences this year and it's certainly placing some pressure on police resources to have to continue to attend to these matters.

"I spoke to a couple of residents out there this morning and they were quite shocked that such a thing had happened in their quiet suburban street.

"To wake up and find a deceased male person laying in the middle of your street, who had allegedly been the victim of a gunshot, is obviously of serious concern."

Australian law makes it nearly impossible to legally use a firearm for defensive purposes.

They should be thankful that an armed citizen did their job for them...

If a home invasion type criminal can be referred to as a “victim” it’s probably best to skip the Australian stop on the tourist circuit.

You are correct. In Australia, you are not allowed to use a gun in defense of yourself, even if you took it away from the aggressor.

Making self defense with a firearm illegal is one of the most important steps in the gun grabbers playbook. They did it in England and Australia, and have pretty much done it in Canada, though they are getting some push-back there.

If we did not have the Second Amendment, they would do it here. As it is, we only squeaked by in the Supreme Court with a 5-4 vote.

Self Defense trumps all gun control, which is why the enemies of freedom have to make it illegitimate.

The home owner is still at fault regardless of what happened, He must have done SOMETHING that encouraged the Crim, er. citizen to to do what he is alleged to have done which resulted in his death/S

Timmy, I am also shocked. It's "lying", not "laying". "lay" is transitive, whereas the dead guy is pretty much intransitive.

Swords are also banned in Australia for self defense. In Australia, you are not allowed to carry a pocket knife unless you can show a "need" for it.

How to import and own a sword in Victoria, Australia

Summary To import and legally own a sword in Victoria Australia the cheapest and easiest way is: 1. Join the AUSTRALASIAN KNIFE COLLECTORS (AKC)

2. When importing the sword into Australia tell Customs you are a member of the Australasian Knife Collectors club. Customs will let the sword through as long as you have an exemption with the Victorian Police. Being a member of the club is a valid exemption.

3. Check out the storage requirements for swords. Make sure you comply with them.

4. Thank the Victorian government for protecting the public from the likes of you

The Victorian Department of Justice defines a prohibited weapon as Prohibited weapons are weapons that are considered totally inappropriate for general possession or use because they are exclusively offensive in nature. Such weapons cannot be imported, manufactured, sold, possessed or carried.

A person may have access to a prohibited weapon only if she or he has obtained an Approval from the Chief Commissioner of Police, or falls within an Exemption made by the Governor in Council. The following items are prohibited weapons: 1. “Sword”, being a thrusting, striking or cutting weapon with a long blade having 1 or 2 edges and a hilt or handle. The penalties for breaching the Control of Weapons (Amendment) Act 2000 include a fine of up to $12,000 or six months imprisonment.
