I think the defense lawyer may be smart enough to intentionally set up an appeal on the grounds of ineffective representation. There are grounds for reversal of any conviction on that theory alone. Once reversed The People will not want to pay for a new trial and thus the waiver of the death penalty becomes a bargaining chip. Ineffective representation may be a smart move.

From what I have seen much testimony has been allowed in without the necessary foundation which is the judges fault-unless the DA failed to object.

Do you think that an appeals court is so ignorant that they can’t spot a dumb lawyer trick. Intentionally throwing a trial doesn’t get you a new trial. It gets you disbarred.
