“Jose Guerena’s contact with law enforcement began in late 2009 when he was a passenger in a vehicle carrying large, commercial- sized rolls of plastic wrap that deputies believed was used to wrap large loads of drugs, but no drugs were found inside, the document said. That same year, Immigration and Customs Enforcement agents investigating a narcotics case saw two men driving a loaded car to a residence where they found more than 1,000 pounds of marijuana. The two men were followed after they dropped off the marijuana at a house. Jose Guerena was at the house, but he was not arrested in connection with the case. Two men are awaiting sentencing in that case.”

You may not be aware that the warrant was to search the house.

Holy crap. The entire family is involved in drugs and dealing. It is obvious with multiple arrests.

Um - the case was closed. He was arrested, his wife posted the $2500 bail, and he was released with the stipulations of no weapons, no drinking & driving, has to have a driver’s license to drive, and a Rx for drugs. (And the last three are reminders of things that are illegal anyways!).

Later, from those same links, it says the case was dismissed and he was not charged with any crime. The $2500 bail money was returned to his wife. I’m going out on a limb here, but I’m guessing that any stipulations on his release on bail (that did not describe already illegal activites) were also erased. Such as the possession of a weapon.

We’d probably have to see even more details on the condition of the case being dropped. That will likely come out as well.

The point being, this was no all American boy here. He was involved with drugs, was in a vehicle with materials for distribution, his family was heavily involved.

He knew what was going on and was with family members with materials for distribution. This was a drug family.

The defense narrative of “all american Marine shot down” just doesn’t fly.

OK. I stand corrected.

Am I reading this right? He was arrested for Possession of marijuana, Possession of drug paraphernalia, and Weapons Misconduct Charge?

And the charges were not pursued?

It’s probably a safe bet that he or someone he was with had a minor amount of pot with a pack of rolling papers and a pocket knife.

There’s still nothing that points to him trafficking drugs from his home. And certainly nothing that would require a SWAT team to serve a search warrant.

lol, yeah other than the fact that his entire family was involved in drugs and Jose was a member of that family...and that Jose was caught with drugs, paraphenalia and that Jose was riding in a car with drug related distribution materials...

oops...I’m pretty sure AR 15s are included.

That was the terms of his bonding out of jail. He was never charged in court. So does that mean his Second Amendment Rights stay revoked for the rest of his life without due process?

However, we do not know the conditions if any of not pursuing the charges.

What do you think of the car (his younger brother) that followed the police car and illegally ran its plate using a contact in the DMV?

Sounds like they thought they were being cased by a home invasion crew and decided to find out who was sitting in a car outside their home watching them.

Good question. I don't know.

I'd have probably done the same thing under identical circumstances when I lived in Sacramento.

Now that I live in suburban/rural Georgia, I'd just call the police because they'd actually send someone to check it out.

Interesting. I still don’t understand why the police in many jurisdictions would use a raid like this instead of just arresting the suspect on the way to or from work. Seems like it would be easier and safer for all involved.

Guerena was arrested in 2009 but never charged. The documents show Guerena was arrested for drug possession, having drug paraphernalia and weapon misconduct. 9OYS also has discovered Guerena's wife, Vanessa, paid a $2500 bond to bail him out of jail but that money was returned to her when no charges were filed.

No charges were ever filed...lol. No criminal record.

That’s generally my thoughts on the matter. The reason for SWAT in this case is because of the nature of the people being investigated. They are all related, and one could have tipped off the others to destroy evidence. Therefore, the searches were simultaneous.
