“The two men were followed after they dropped off the marijuana at a house. Jose Guerena was at the house, but he was not arrested in connection with the case. Two men are awaiting sentencing in that case.”

Now, can anyone explain why items such as a wedding ring and military medals were seized? What is going on in this nation?

Its a drug raid. They get to keep anything of value. She has to prove that the property was not obtained by drug profits.

What do you think of the car (his younger brother) that followed the police car and illegally ran its plate using a contact in the DMV?

Jose Guerena was never arrested. The article says that in 2009 he was in a car that had rolls of plastic in it, and no drugs.

Wow. What a dangerous criminal.

Would you like to enlighten us on what the Pima County Sheriff Dept. had to show for probable cause that Jose Guerena was trafficking drugs other than his brother is a dirtbag and they acted like they knew each other?

Jose Guerena's contact with law enforcement began in late 2009 when he was a passenger in a vehicle carrying large, commercial- sized rolls of plastic wrap that deputies believed was used to wrap large loads of drugs, but no drugs were found inside, the document said.

Outlaw plastic wrap!

Can you always get a search warrant on such flimsy premises?

No, because it won't be released for another four hours. Unlike you, I don't make up my mind before I have enough information to make a reasoned conclusion.

What do you mean? I don’t think anything of it. I certainly do not think it justifies kicking the other brother’s door in and shooting him down. On his earlier arrest, at the end of the day they released him without charging him and returned the bond money. That tells me he did nothing wrong except “act like a drug dealer”, whatever that means to county attorney. The same county attorney is right now in full blown CYA mode in anticipation of the huge lawsuit he is no doubt expecting to be dropped on the county as a result of this debacle. I would take anything he or any other LEO in that county says about this case with a huge grain of salt.

Regardless of what comes out, if he was working with his brother or not it was wrong to kill the guy who was not a threat. There was a mistake made. The officer at the door accidentally fired his gun and everybody else thought it meant that he was being shot at.

You don't bust into a guys house and kill him with 72 rounds fired at him for suspicion of running drugs. You let a court decide what to do with him. This is a wrongful death situation period, all the other stuff doesn't matter. If the cop had gone to the door with his backup and accidentally fired his weapon while knocking on the door to serve a warrant he could have apologized and gone about his business searching the place or locking up the guy.

This stinks. I have a son that is a cop, not all cops are bad but they all think that nearly everybody else is. We gotta get rid of the SWAT teams and the no knock searches. Neither of them have a place in our constitutional society.

I happen to be LE and that's just not true.

Your son will certainly tell you, if you ask, that in a situation like that, it's easy to second guess from the comfort of your sofa, it's not so easy to make a split second decision when your life is on the line.

This does not appear to be a situation where LE showed up at the wrong house and shot an innocent lying in their bed.

If he was in a home invasion crew, he was setting yourself up for this type of situation.

However, I'm going to wait for this to all play out before I make up my mind.
