Yep. He should be able to categorically confirm or deny that the picture is him. Either he took that picture or someone else took that picture from very close range.
I guess there is the possibility that he is a sound sleeper and some pervert came into the room where he was sleeping.
But there are very few scenarios whereby someone could come by a close range picture of your boner without your knowledge.
