You are about the only one here close to the truth. Competency to stand trial has nothing to do with being legally insane, nor does it have anything to do with sentencing. It has only to do with whether the defendant is able to assist in his own defense, or is he so impaired by reason of mental illness that he is not capable of assisting in his own defense at the time of trial.

If found incompetent to stand trial, he will be sent to a forensic psychiatric unit where he will be treated for his illness and hopefully restored to competency. Many such defendants are restored and eventually stand trial.

They then can plead "not guilty by reason of insanity,(NGRI)" and will then go through a whole new process of evaluation, the results of which which will be evidence presented to the court. NGRI pleas seldom work, unless they are obviously the right outcome. I doubt this guy will be found NGRI.

NGRI relates to mental status at the time of the crime, while competency relates to mental status at the time of the trial.

Many people think there is a loophole here that allows all sorts of criminals to run free and thwart justice. This is not so. Consider NGRI John Hinckley, who is still committed to the state hospital all these years after his attempt on Reagan. Most NGRI findings lead to commitment for at least as long as a guilty verdict and sentence would impose.

The federal law and some states including Arizona do have a substitute for the NGRI plea, which is "guilty but insane." It works out about the same in practice, either way the person is institutionalized for a very long time.

The difference is that an NGRI can hypothetically be treated and recover enough that a panel of doctors could deem him safe to return to the community. I don't know if this has ever happened in recent years, and certainly not with a high profile case. With GBI such a rare case would not lead to release but to prison to serve out his sentence.

He killed an innocent child, tried to kill Gabby - she’s an admirable woman.

He should have been shot like a rabid dog, because that’s basically what he is. Where are all those concealed carry folks?

What is Loughner.....of illegal immigrant, Jewish, Muslim, Hispanic, European, WASP, Catholic, or Christian misc heritage, etc?

Americans deserve full transparency on those who report, and commit crimes and those who run for office. Instead of hiding their demographic background we should know it.

Neither expert thought Loughner was faking his mental health problems, with one of the therapists saying Loughner doesn’t want to be perceived as mentally ill. A hearing to revisit Loughner’s mental competency is set for Sept. 21.

...If he isn’t deemed competent at the end of his treatment, Loughner’s stay at the facility can be extended. There are no limits on the number of times such extensions can be granted.

If doctors conclude they can’t restore Loughner’s mental competency, the judge must make another decision. If he finds there’s no likelihood of Loughner being restored to competency, he can dismiss the charges.

Of course he is “insane”...what sane individual would kill several random people...and smile.

He does not deserve to take any of society’s limited resources. He should be eliminated.

He was also a MAJOR pothead.

IMO, anyone with that background and enough sense to lie on the 4473 about that usage, is flat out guilty enough on any charges that come.

This is so ridiculous. He’s guilty, he lies to get his way and now he’ll be a happy camper in the hospital.

Actually, he’s not as nutty as the judge, who is as nutty as the Supreme Court (?)justices(?)who have told California that they must release approx. 46,000 out of their prisons because they are crowded and uncomfortable.

IMHO, the first person that gets murdered by one of those 46,000 was actually murdered by the Supreme Court 5 who allowed them to be released.

Do ya think that maybe someone would have the guts to sue the Supreme Court 5 - or demand that they be arrested for aiding and abetting?
