I think they're more concerned that the court, evev with a new vote to pass, would invent some reason why the law is not constitutional. And because it would be a state constitutional issue, there wouldn't be any opportunity for Federal review. They're also concerned that any other such action by the Walker Administration would be thrown out on specious grounds as well.
But your point about not having the votes may be true as well -- if this is a decisive defeat for Prosser, you may start seeing some R's turning into RINOs out of fear of the unions. Which would, frankly, suck.
They will just keep shooting it down in the courts.
The democrats are actively promoting voting for someone on the judicial branch to prevent the executive and legislative branches from functioning.
This will not be allowed to occur. We will have a revolt in this state before this happens. Actually we will probablt have judges removed from the bench before that.
