Theyre not just blindly defying the order here. The argument, as it was last week when the Legislative Reference Bureau published the law, is that the TRO only names certain parties and therefore only those parties are enjoined by it. Theres no mention of the Department of Administration in the order, so hey the Department of Administrations going to go right on ahead and execute the CB law. Grassroots conservatives will love that, but if Wisconsin were chock full of grassroots conservatives, Mickey Kaus wouldnt be writing posts like this. Now that the judge has doubled down on the initial order and emphasized that the law shouldnt be implemented further until theres been a ruling on the merits (Thats what I now want to make crystal clear), if the Republicans ignore her and go ahead with it, theyll be held in contempt and itll play straight into the lefts hands before the crucial state supreme court election next week. I.e. we must stop this lawless band of rogue Republicans by ending their majority on the bench, etc etc etc
Department of Administration Secretary Mike Huebsch said he has a legal obligation to implement all laws that have been passed by the Legislature, signed by Gov. Scott Walker and published into law.
Huebsch pointed out that the DOA is not a party to the lawsuit, and the order fails to state the law is not in effect.
It is unclear how she can issue an order binding non-parties to a case who have not had their day in court, he said in an email.

That is major news! It would be a 24/7 news cycle event if these were Democrats being overruled by a Republican judge.

Take the lib’s playbook and use it against them for a change......screw the activist judges who love to legislate from the bench, especially when they don’t have the jurisdiction to make such a ruling in the first place. The bill was voted upon, and signed into law by the Governor. Implement it, that’s how the system works.
If the libs don’t like it, let them go AWOL again. It’s not like they are doing anything productive when they were present anyway.
From what I understand, her husband contributed thousands of dollars to help finance some of the Dem politicians who were on the run.
The “judge’s” authority to rule in this case needs to be challenge. Just because her son is a union thug activist, I don’t think that gives her the authority to rule on a perceived violation of the state legislature’s procedures. This is none of the court’s business.

Here’s what happens on the pattern of O’Donnell over Castle, also an isolated, low turn-out election. As expected, turn out is light, the better GOTV machine of the Dems seems to be working as planned. About 2 PM , Rush picks up the story of Sumi’s family union ties, the son’s pronouncements, etc and spends a full hour on it. There is a surge in the turnout. Hannity follows up with 3 hours of beating the bushes, turnout ticks up from the expected 15% to 25% and Prosser wins.

Good for them. These lower court judges have no jurisdiction over a soveriegn state. The Constitution is very clear that only the SCOTUS has jurisdiction over a state. They need to tell that judge “See you at the Supremes”. Sounds like that is exactly what they are doing.

Maryann Sumi - Where is your army? The elected officials of Wisconsin should ignore her, and the Gov. should send the state troopers to “protect” her. If bambi can ignore the rule of law, so should all state executives.
Wow!!! This is a bold move. The judge has issued an injunction against implementation of the bill. In federal cases government usually asks for a stay while they appeal the injunction. But the Department of Administration is going to ignore the injuction...it sounds like we are about to have a major food fight in the Cheesehead State.
Is it possible that the law will be implemented in defiance of the injuction and remain in that state until a Democrat governor is elected and then he/she can choose to overturn it? And then Republican governor cans re-implement it whenever they run the state.
