If you remember, I questioned whether Obama was crossing the line into sedition with his statement that he intended to ignore a declaratory judgment.

Well, they apparently (after stalling) asked the Judge for a stay, and got something a bit different than they asked for in reply.

Judge Vinson began with:

I read the order on another thread.
The judge is not patient with fools. Nor should he be. He has set the clock ticking on the appeal and slammed home the opinion as binding...not that it will stop the Socialists for a minute, nor will the press ask about it in the White House briefings.

I’m no legal eagle, but - isn’t granting a stay at this point kind of wavering (going ‘wobbly’, if you will)?

Seems to me that just buys the Admin time to execute their thug tactics on the Judge. Make no mistake - the Chicago boys stand ready to do their thing if given the order.

Read pgs. 15-18 of the order for the legal reasons why a stay is granted.

Notice also, the 7 day stay window for appeal.

The judge did not grant an extended stay—this is almost immediate—the purpose of which is to kick the case upsatirs to a higher court ASAP to get it to the Supreme Court, for the best interests of the public.

Remember he is not the only Federal judge who has weighed in on the issue, and a higher court will have to determine which view of Obamacare is the coreect and Constitutional one.

And if they get it wrong, the Congress will have to settle the matter.

Well, count me confused. I get that he emphasized that he has declared obamacare unconstitutional. What I don't get is why he gave them the stay.

It seems to me to be the equivalent of a parent saying to their 7 year old: “yes, I told you to go to bed and you are ignoring me, and you have said you will continue to do so. By golly now I'm gonna get tough! You have until the end of that show you are watching to ask mom if you can keep staying up!”

Did I miss something here?

Apologies to any 7 year olds regarding the comparison to Obama.

On Drudge the President had a press conference with Mexican President Calderon. The US Press had one question allowed of President Obama.

Q. Did they ask about the former Mexican ruling party admitting they coordinated drug cartel shipments into the United States for most of the 20th Century?

Q. Did they ask about the federal judge who not only declared the administration's Obamacare implementation unconstitutional, but that same judge ‘clarified’ that position and inferred the administration was in contempt of a federal court and had only 7 days to appeal the ruling that would reorder 1/6th of the economy?

A. Why no! The AP reporter asked if there was an NFL lockout would the President intervene!

The absolute opposite is the case. This order put the regime under an extremely short window to either give up or appeal. They were riding the clock out previous to this order. Technically Obamacare was dead with Vinson's original ruling. Because he saw them disregarding it, he is jamming this short stay down Obummers throat. This is awesome and there are panic meetings in the WH tonight.

They asked for a clarification, which he knew was just another excuse to drag this out. So he said he would rule on this as if they were asking for a stay(they hoped they could wait awhile before filing for that) and then said, ok you have 7 days to file an expediated appeal or stop all implementation of Obamacare. That completely jinxes their plan to drag this out as long as possible while continuing to implement changes that will be very hard to reverse the longer this goes on.

While granting the stay for 7 days, Judge Vinson ordered the Administration to seek an EXPEDITED appeal, either to the 11th Circuit OR to the SCOTUS. An EXPEDITED appeal is the last thing this Administration wants.

An appeal that is not expedited can take months and months and months, a good year or so. An EXPEDITED appeal can be handled quite quickly, and a decision made that moves the case along to the SCOTUS much sooner than a regular appeal.

The one week stay they were granted with that critical caveat has cost the Administration months of time they’d hoped to use for delay. This case could (not saying it will) be at SCOTUS in a month or two, assuming the Administration choose the intermediate step of the Court of Appeals. A losing party at the appellate level has 90 days to file with SCOTUS, but given the way this particular case is going, they may be ordered again to expedite any SCOTUS appeal.

VA tried to get its case expedited and DOJ flatly refused. Now, in the FL case, the Administration has NO choice.

You know, between this defiance of the court AND being in contempt with the federal court over the oil drilling ban, as well as BHO and his justice department refusing to enforce the law and choosing to ignore/not pursue numerous wrongdoings - what I don’t get is why Glenn Beck doesn’t go into all this and bring public attention to it. I mean, why does he seem to be taking a hands-off approach now concerning this impeachable president?? Did he get scolded so severely over the one (and only) Van Jones misstatement or his remark about BHO’s kids that now he lacks the courage to point out all these very serious things specifically whenever he talks about the “enemy within”? I mean, we all know who the greatest enemy within is, don’t we? And the radicals and big unions are not where the root problem is - it goes to the very top. But millions of folks who aren’t as informed as we are here, or who haven’t taken the time to research, really need to have all this brought to their attention. God knows they’ll never hear it on any tv or radio source other than FNC. O’Reilly’s a lost cause, but GB’s got the most research and both he and Hannity normally would be gutsy enough to voice it.

Thoughts? And I’m not buying the excuse of the Saudi prince’s 7 percent or so investment. He and Murdoch are old business friends and have invested in each other’s things for years. As an investor, he’s looking at return on investment first and foremost, and muzzling FNC voices would be the kiss of death. FNC still covers and reports many stories that no one else will, but where this president is concerned, they need to find a way to do more. And soon.

I’ve only read excerpts (too late in the day to get into it right now), but what I’ve read looks anything but wobbly. Actually, it borders on a total smackdown of Obama and company. The stay is granted only on condition that Obama expedite the appeals process toward a final ruling by the SCOTUS. And some of the ancillary remarks about the administration’s decision to ignore the ruling just made me chortle with glee.

I wouldn't be surprised if he tried to pull a DOMA [in reverse]. Instead of saying that he won't enforce the law because he feels it is unconstitutional [DOMA], he'll say he will ignore the federal judge and enforce the law [healthcare] because he feels it IS constitutional ...
