PHOENIX Federal appellate judges have refused to overturn the civil verdict against a Cochise County rancher found guilty of illegally imprisoning 16 border crossers.
In a brief and unsigned opinion, the three-judge panel of the 9th Circuit Court of Appeals rejected arguments by Roger Barnett that the Tucson jury that found him liable should have been told by the trial judge that they could consider his claim of self-defense.
The judges said Arizona law allows someone to use or threaten to use physical force against another when a reasonable person would believe that is necessary to protect against the other party's use or attempted use of physical force.

I wish I had been on that jury. We would still be deliberating. There is no way in hell I would have voted to convict this guy. But unfortunatly Tucson is Arizona’s Berkley, and the jury pool there is very “progressive” and sympathetic to the plight of illegals.

If I am not mistaken, it was Judge Roll, recently murdered by Jared, who gave the illegals standing to bring suit against the rancher.

You are correct. I also heard that he was generally a judge that prosecutors liked because, as a former prosecutor, he treated them with favorably.

This is just insane. And they wonder why people don’t trust the federal government. This guy thought he was doing the right thing, and he gets sued by a bunch of Mexican illegals. And the federal court agrees with the Mexican illegals.
