Florida Attorney General Files Motion to Add Six New States to Lawsuit Challenging Federal Health Care Law

Florida Attorney General Pam Bondi today filed a motion to add six States to the federal health care lawsuit – Iowa, Ohio, Kansas, Wyoming, Wisconsin and Maine. This motion brings the number of states to 26, including Florida and the National Federation of Independent Business (NFIB), in challenging the federal health care law as unconstitutional. Also challenging that law in a separate lawsuit is Virginia, and Oklahoma has announced its intention to do the same.

“It sends a strong message that more than half of the States consider the health care law unconstitutional and are willing to fight it in court,” said Attorney General Bondi. “I look forward to continuing to defend Florida's families and businesses against this unconstitutional law and upholding the Constitution.”

The Florida lawsuit challenges not only the law’s requirement that individuals purchase health insurance or face a penalty, but also its substantial and costly Medicaid expansion. Florida Governor Rick Scott and 32 Governors wrote the White House protesting the “one-size-fits-all” Medicaid approach forces states “to cut other critical programs.”

“Having a majority of the nation’s states involved in this case along with NFIB, who represents more than 350,000 small businesses nationwide, sends a strong message to the courts that this law is detrimental to the entire nation and must be overturned,” said Karen Harned, executive director, NFIB Small Business Legal Center.

Prior to today’s filing, the bipartisan lawsuit included the following states in addition to Florida: Alabama, Alaska, Arizona (Governor, and now Attorney General), Colorado, Georgia (Governor, but now Attorney General ), Idaho, Indiana, Louisiana, Michigan, Mississippi (Governor), Nebraska, Nevada (Governor), North Dakota, Pennsylvania (Attorney General, but now Governor), South Carolina, South Dakota, Texas, Utah, and Washington.

26 states so far have joined the Florida action but others, like Virgina, have separate actions. Is any website keeping a scorecard? The Florida action, the independent actions and those pending. Plus due dates when the courts will act on them.

Republicans going on Sunday ‘News’and political cable shows being grilled about repealing the popular parts of Obama-care should keep repeating how one party rammed through a bill written in secret, that their own party members never read, that imposes a new system on all 50 states, and that 26 states are now suing to get out.

After Obama-care repeal fails to pass in the Senate, or get’s veto-ed, Republicans should write a bill that lets states opt-out of all provisions on Obama-care, even the new taxes. Let Democrats try to object to that. Why not let liberal states have Obama-care?(Why do I have to think of all these things ? LOL)

ya know whats coming? States bankruptcy. Bet anything ‘Bammy tells ‘em “he’ll” bail them out..only if they drop the suits.

The problem with letting so many join is that with 1 ruling they can all be cut off at the knees. My opinion (which may be shortsighted) is that you come at it with so many lawsuits from many positions as to guarantee a few get to the SCOTUS.

I'm thinking that a new Congressional law (repeal) may not even be necessary....the states collectively may get it done through the courts.

Repeal would be icing on the cake, signed by Madam President Palin.

The feds don’t have the money to bail them out nor will the House agree to such bailouts. Obamacare will add to the state’s fiscal problems by adding 18 million to the Medicaid rolls. The states must come up with about half of the money for these new additions after a few years once the federal subsidy ends.

The House needs to pass a bill that states any legislation passed will apply to Congress.

It is a crime Congress can exempt themselves from punitive legislation.

States facing bankruptcy are not, I believe, among those suing the Feds over Obamacare.
