Using marker at school leads to OKC teen's arrest

Perhaps parents need to check supply lists and backpacks before sending their students back to school after winter break.

A 13-year-old was arrested Friday in Oklahoma City, accused of violating a little-known city ordinance that prohibits possession of a permanent marker in some circumstances.

The teen was caught using a permanent marker at Roosevelt Middle School by a teacher, according to the crime report filed with the Oklahoma City Police Department. Delynn Woodside noted the marker had bled through a piece of paper onto the desk and reported to a police officer that she also had seen the teen writing on the desk with the marker, the report said.

Woodside, a seventh-grade math teacher, made a citizen's arrest on the teen, and the police officer transferred the student to a Community Intervention Center that houses juveniles who have been arrested. The name of the minor was not released.

District spokeswoman Kathleen Kennedy said district officials will look into the incident when students return from winter break, which began Friday.

Under City Ordinance 35-202, it is illegal for any person to possess spray paint or a permanent marker on private property without the permission of the property owner. “No person may possess an aerosol spray paint container or broad-tipped indelible marker on any private property unless the owner, agent, manager, or other person having control of the property consented to the presence of the aerosol spray paint container or broad-tipped indelible marker,” the ordinance reads.

The law appears to be directed at curbing graffiti and is under the nuisance chapter of city ordinance.

Talk about overkill. What kind of an a**hat teacher would do this to a kid? I am afraid I would have to punch out a teacher that had my kid arrested for having a permanent marker.

Taxpayer supported schools are not private property. After all, they are “Public Schools” right?

The ironic thing is that the student, being a product of the OKC public school system, had no idea what the word permanent meant.

“Winter break”? In my day we weren’t afraid to call it a Christmas break, but then, those were the days of real Americans who didn’t mince around afraid of their shadows and an out of control nanny government and it’s teachers who bully children instead of teach.

Those were the days my Dad punched the running lights out of a Principal in his own office over his own desk for bullying my older brother (which was verified first), not a word was said, the principal was later replaced. Amazing stuff. Those were the days when you treated women, especially one’s Mom, with respect, we heard of exceptions of course, but the NORM was respect and manners—or else.

And any cop who felt that use of a permanent marker was grounds for an arrest - even a juvenile arrest - needs to find something better to do with their time. Eat more donuts, run more radar, anything but arrest a child with a marker. How absurd can our society get?

How low do you have to be to rat out a kid for writing with a magic marker at school? Would you really want a person of that character teaching your kids?

When I was in school, we had wooden desk’s and people carved their boy or girl friends initals in it....You always knew who had the desk before you...OMG we’d go to prison today for such stuff....
