Rehberg Takes Aim At New ATF Firearm Sales Reporting Rules

WASHINGTON, D.C. – Montana’s Congressman, Denny Rehberg, today released the following statement critical of a proposed “emergency rule” by the Bureau of Alcohol, Tobacco, Firearms and Explosives (ATF) to require federally licensed firearms retailers to report multiple sales of semi-automatic rifles. The proposed rule was included in today’s Federal Register and specifically calls for firearm retailers to report multiple sales, or other dispositions, of two or more .22 caliber or larger semi-automatic rifles that are capable of accepting a detachable magazine and are purchased by the same individual within five consecutive business days.

“While we’ve managed to stop gun control efforts in Congress, the Obama Administration wants to circumvent the legislative process altogether in order to force its anti-gun policies on the American people. Beyond the economic burden of more paperwork for gun dealers, this rule is predicated on the incorrect assumption that buying multiple guns is a questionable activity that warrants a red flag for government attention. This is the exact mindset that proponents of the Second Amendment feared when an anti-gun Chicago politician moved into the White House. I’ll keep fighting to make sure the federal government respects all of our Constitutional rights.”

Rehberg squares off against Baucus, Tester

Rehberg is Montana's at large pubbie in the House. IIRC, Tester is up for re-election in 2012. I thought two or more firearms bought in 5 days already had to be reported to the BATFE, IIRC.

Yes, I remember back around 1985 I had my neighbor order 3 Swedish Mausers. He did and showed me the form he had to send to ATF. They actually ended up phoning him about it.

Only multiple purchases of pistols within 5 business days need to be reported, and only this because it was grandfathered in before the congressional ban on a national registration system.

Current Fed. “Law” requires submission of a “Report of multiple firearm sales” ONLY for hand guns.

State “law” may have additional requirements.

All are unconstitutional infringements, but let’s not quibble. ;-)

There’s no legislative basis for this rule. The multiple-handgun reporting rule was specifically mandated by Federal legislation. Attempting to promolgatate such a rule for any other type of firearm is another example of the Obammunists doing whatever they like, and the hell with the law.

As a Federally Licensed Firearms dealer, I hope like hell the NRA will fight this if the rule goes through. I’ll also be contacting my newly elected REPUBLICAN Congressman!

Is the current law for multiple firearms including long guns or just handguns?

I wonder if the ATF has changed the regulations back and forth. I am absolutely certain that my neighbor?dealer did report multiple sales and it was around 1985. It could have been 86 or 87.

I also wonder if the law may have been changed as there have been several changes in the 68 law and one of them was around that time. It was sponsored by Senator Dole and allowed the importation of military surplus guns which had been banned in 68.

I guess it is possible that the dealer just made a mistake too.

January 5th? I wonder just what kind of “emergency” they are planning.

This is the standard operating procedure of this administration. Create an emergency, create a terrorist plot....create fear!!! And bingo...!!!

People will willingly allow themselves to be groped or radiated before going on a commercial flight. They will willingly give up their constitutional rights and liberties to pass The Patriot Act again. And the list goes on and on and on...interesting timing on this gun grabbing “emergency” as well.

Obama will not protect our borders and is perfectly happy to reward criminals that come into this country and yet sets out to punish law abiding US citizens by restricting their constitutional rights in the name of security.

The Socialists and Communists will never rest until every fiber of this country is destroyed along with anyone that resists. Never forget, this Administration, through the DHS, identified a large majority of the Citizens in this country as domestic terrorists.

History repeats itself...1930s Germany...

How stupid is this when all the person has to do is buy one rifle, leave for an hour or two and come back and buy another.
OMG! They could even go to another store and buy the other rifle there!

Statist control freaks who won't rest until we're all disarmed.

That was certainly the case some years ago. I bought a handgun and rifle at once, and the dealer informed me that because more than one gun was purchased, he had to report it to the BATFE.

The dealer may have thought it was the law. That does not mean that it was the law.

That's for handguns. They're trying to expand that to certain long guns. I believe they're only attempting to require this of border-state dealers.

That would still fall within their definition of a multiple purchase. They’re saying more than one purchase within five business days is the threshold. Just buy from a private party and then it’s none of their business.
