Breaking: Federal judge rules ObamaCare mandate unconstitutional

CNN has a breaking alert on a ruling by a federal judge in Virginia that rejects ObamaCare as unconstitutional:

A federal judge in Virginia has ruled parts of the sweeping health care reform effort led by President Obama to be unconstitutional. This is the first federal court to strike down the law, contradicting other recent rulings the law was permissible. The key issue of contention was the “individual mandate” requirement that most Americans purchase health insurance by 2014.

This case (Virginia v Sebelius) was the lawsuit brought by the states against ObamaCare. This is the test case that had the best chance of overturning the law, and the states have apparently won an important finding in the district court.

According to Dan Foster at NRO, the judge ruled that Congress “exceeded its authority” by imposing an individual mandate to purchase insurance.

Update: Actually, this suit was brought by Virginia alone. The other case brought by 20 other states in one suit is still pending.

The other cases were on a different basis. For example, the one brought by Liberty had to do with religious freedom and abortion. They were no way “wins” on the issue of the overall constitutionality of the individual mandate.

The very idea that requiring people to buy insuranec is constitutional is absurd. The Constitution was written by men who insisted the government could not require them to buy stamps.

When I was working for the USMS in DC, Henry Hudson was our Director.....I was sure hoping he wouldn’t let me down and rule for this disaster.....he came through with flying colors! I guess zer0 will now blame Bush for this since Hudson was appointed by W....LOL

Look for the left to now start complaining about the judiciary ‘thwarting the will of the people’ from the MSM and liberal dems.

Course they never say that when liberal judges legislate from the bench and thwart the ACTUAL will of the people. Like CA Prop 8 for example.

Quick...someone alert President Clinton...er, Obama...er, no, Clinton will take the hard questions on this one, too. Not sure where Obama is hiding since this news started breaking. So, when is the press conference that will show the podium with or without the Presidential Seal? I mean, we should be certain to know who is leading our country since Obama is sure to be stuck in melt-down phase somewhere.

Some on the left are not unhappy about this ruling. They think that if the mandate to purchase private health insurance is shut down, that will give Obama incentive to try to get a single-payer system in place.

He couldn't get that when he had overwhelming control of the House and 60 votes in the Senate and an 80% approval rating. He sure has heck isn't going to get a single payer system now.

The ObamaCare law has no severability clause. If any part of the law is found to be unconstitutional then the whole law is nullified.
