Oh, I’ll bet they were. Say what you will about Axe, Gibbsy, and the rest of the crew, but I’d like to think they have the basic political common sense to avoid photo ops where the president has to skip out after a minute or two to go eat gingerbread cookies.

I’d like to think The One had the same basic political common sense, but … we learn something new every day, don’t we?

So Joe appoints Bubba as his VP and then Joe steps down and let's Bubba run the show for the remaining two years. Joe agrees to it in exchange for the guaranteed VP slot (or some other sweetener,) from Hillary in 2012.

Bubba's the only one able to keep Obama's constituency from descending into violence...and even if Obama is wanting to step down of his own free will (which I think is just as much the case as it being a forced exit,) black America will view his resignation AS being one forced. And that fact makes it more plausible that the party and elected officials would seek out Bubba as really the only one (in official placement) able to avert a pantload of crises. Obama needed to trot Bubba out *now* for at least a photo-op and a few words together to put on record that the two are on the same page and all tight. (Obama was hoping that the staged public BFF scene would last only a couple of minutes, and they'd both be on their way. FAIL.)

Wasn't someone saying that Bubba is actually able to serve ten years instead of eight? Might this scenario fit if the law is that extra time served is allowed past two *elected* terms? I don't know the law.

An appointment of a replacement Vice President has to be confirmed by a majority of both the House and Senate (25th Amendment, section 2). There is some ambiguity in the 22nd amendment since it explicitly uses the word “elected” and some might argue an appointment is different. However, the counterargument is the 12th amendment with its eligibility language. Obviously there would be controversy and SCOTUS would be involved. While the RATs hold a slim majority, enough might be Constitutionally minded and hold to the spirit of the 25th to not vote to confirm. Either way, it becomes moot on Jan 3rd when the House goes Republican. No way in heck would they confirm Bubba to the Veepship.

I think if anything is there, it is more along the lines of his passport records, nationality claimed, countries visited, length of stay, etc.

The XII Amendment says the VP must not be "ineligible to the office" of President, referencing Article II.

Article II eligibility criteria are 1) NBS, 2) 35 on inauguration day, 3) 14 years continuous US residence, immediately prior to inauguration.

Neither XII or XXII modifies "eligible to the office". I imagine the drafters of XXII were striking out at FDR, and they did not imagine that a fatherless degenerate could ever become President.

But WJC is, absolutely, "eligible to the office" of President, and hence VP as well - he just can't become POTUS again via election.
