New York has extremely lax residency rules for its candidates. That difference is part of federalism and state sovereignty.

The Illinois residency laws have previously been upheld in court as not unduly burdensome and as being related to a rational policy purpose.

The residency requirements for municipal officers are not especially recent. The policy is almost a century and a half old. Emanuel did not trouble himself to read the Election Code.
