No. But he was breaking the law by driving drunk regardless of any ill or good effects of his foray. Should the driver in the real accident and the one in your hypothetical be excused/busted because they were/were not drunk?

The answer is "no". Drunk driving is a crime, whether the drunk is snoring in an idling car at a commuter lot or plowing into a motorcycle group at speed.

No one ever said he was drunk, the report is that CHP smelled alcohol 5 houirs after the accident and at that time arrested him on suspicion of being under the influence. Fact is, if they did not have him in custody immediatley afdter the crash and they waited five hours to administer a blood test, it is virtualy meaningless.

A much more realist scenario...

It would be like me being drunk, and someone rear ending me, at 5MPH at a red light....And since I am drunk, my foot hits the gas, instead of reacting properly and hitting the brake, causing me to drive into the intersection, broadsiding a car full of cub scouts, killing them all.

Isn’t Highway 98 the road that parallels the border a couple miles north of it? That’s where I thought it happened, near Ocotillo off of the 8. You may be thinking of Ocotillo Wells.

CHP said he reeked/SMELLED of alcohol and was arrested on suspension of DUI.

Question:

If the Mexican was drunk and or *impaired* by alcohol, could this have been a cause of him losing control of his vehicle, crossing the center line and killing the American bikers?

Yes or no?

Well, of course he should be punished for DUI if he was drunk. I even said that. But the question about who’s at fault for vehicular manslaughter is still an open question.

This is what I read:

A suspected drunken driver who killed five people when his car slammed into a group of motorcyclists has been released from custody in Southern California.
Maybe this isn't correct, which is why I asked why the guy was released; but you just come up and assume that this sweet Mexican is being discriminated against.

Clearly your statement which I quoted is wrong. The people who suggest he was drunk may be wrong too. But I have to wonder why you would misrepresent what is going on here.

Why yes....lol...

It would be like you being drunk/impaired, and me bumping your car, and instead of braking and pulling off, you lose total control due to being intoxicated, hitting a power pole, bouncing back into traffic and slamming a Jewish lawyer in a Mercedes.

And by the way, the Mexican driver was injured with multiple fractures and transported for treatment..The scene was a chaotic mess and most were not directly concerned with DUI's when arriving at the scene, as opposed to saving lives and transporting...This was basically in the middle of nowhere, and I believe that is why it took time for the CHP to get a whiff of the Mexicans breath, probably in the ER.

In the interest of facts, leeme re-word this just slightly.

The Mexican driver was injured with multiple fractures to has hand and possibly arm....I ASSUME he was transported for treatment...The scene was a chaotic mess and most were not directly concerned with DUI's when arriving at the scene, as opposed to saving lives and transporting.....This was basically in the middle of nowhere, and I believe that is why it took time for the CHP to get a whiff of the Mexicans breath, *probably* in the ER...His passenger was killed, but was also likely transported unless dead at the scene.

Based on the fact it was the Mexican driver that hit the bikers head on, causing multiple fatalities, including his passenger.... I am confident law enforcement DID NOT CUT HIM LOOSE to go have a few cold ones at the local bar, prior to interviewing all involved.

Well, it makes a person wonder why they would wait FIVE hours before arresting him. If they thought he was drunk they would have arrested him immediatly at the ccrash sight. But no, they waited five hours and then only because someone at CHP said they smelled alcohol. Maybe he was and maybe he wasn’t, but, if they realy thought he was intoxicated at the time of the crash, IMHO, they would not have waited so long.

one thing I despise....is a government that takes sides against their own people(that pays their wages)and act like they don’t even know you as an American citizen and refuse to acknowledge right from wrong because of COLOR!!! And side w/ a foreigner..that is not even A citizen.
