"What about buying drugs or having in your possession, drugs for someone that is incapable of doing it themselves?"

Well, licensed care givers are exempted (with some limitations) from such laws. So, if you're a nurse, for example, you would be allowed to carry medication for your patients.

If you're not licensed, then you had better have some kind of legally recognized guardianship of the sick. Perhaps you're the parent, or the legally designated adult to make medical decisions for the ailing party.

But, people get arrested (and prosecuted) ALL THE TIME during routine traffic stops when they have someone else's prescription drugs (Sched-III) on them.

Exactly. Repeating a theme, we need less laws and LEO’s and more carrying citizens. Costs less, with significantly improved results.

This asshat needs to be taken out back and beaten with a rubber hose to within an inch of his fascist worthless life to stand as a warning to all the other fascist asshats with aspirations of totalitarianism.

To the last, I will grapple with thee... from Hell's heart, I stab at thee! For hate's sake, I spit my last breath at thee!

In other words Lee County Sheriff Tracy L. Carter, F*@$ off and die.

Considering this, it might be safer and more private to get marijuana, heroin and whatever else from the friendly neighborhood pusher than to have a prescription open to lookies by any cop who fancies the notion.

The last thing I want is some dimwitted thug on a power trip deciding if a prescription is medically warranted. People will go bankrupt defending themselves against these morons.

That’s why I was asking. People pick stuff up for other people on the way home or to the store, etc., all the time. I didn’t know if it was illegal. I hate to see a law like this happen. If someone has a back ache, they should be able to take a friends pain pill without fear of arrest.

Why not? This makes entirely too much sense, given that too many people have begged the government to stop people from harming themselves, freedom be damned.

Besides, I'm sure it's all for the children. As long as its for them, it's ok to do pretty much anything to anyone (/s).

The WoD has been going on during most of my adult life. I remain appalled at the number of so-called conservatives who are willing to throw away everyone's freedom with both hands to prevent stupid people from messing up their own bodies.

With all the money spent, with all the police forces militarized, and with all of the freedoms (and lives) lost, I defy anyone anywhere to come up with a single addict who had to quit because they just couldn't find any drugs to ingest. Just one. I'm waiting...

I'd also like anyone who supports the WoD to explain how they ever thought that the power they've begged the government to take wouldn't eventually be used against them. Naive doesn't even begin to cover this sort of delusional thinking.

We need to pass and enforce strict laws against harming other people while intoxicated with any substance, then legalize drugs and let people do what they're doing anyway, minus militarized police, dead innocents due to warrant-less searches, the lack of privacy, and huge tax bills.

Now, who on this site still believes in the war on drugs after this kind of police state tactics? I would rather deal with addicts than a paramilitary group at my front door...

"People pick stuff up for other people on the way home or to the store, etc., all the time. I didn’t know if it was illegal."

They do. Those people are generally known as "patient's agent". Most states have patient's agent exceptions, but these exceptions do vary.

Much of this comes down to the discretion of the investigating officer, unfortunately. If you look like an otherwise law-abiding citizen, but have someone else's Sched-III prescription meds on you and a good excuse, you'll probably not get any grief. Most laws allow exceptions for people acting as a "patient's agent" so long as they are acting in "good faith", which is a specific legal standard.

If you look like you're looking for your next fix, or the drugs were discovered whilst you were committing another crime, you'll probably get some grief.

This is a very, very big problem.

The government has identified "prescription drug abuse" as something that needs action.

There is no doctor that can't be taken by a scammer - unless that doctor never prescribes narcotics.

Yes, there are a few scrip doctors - but everyone knows who they are, you don't need DEA to find them - just ask the ER docs.

In a year, there will be "unexpected" access problems for cancer patients with severe pain.

Bet on it.

Sorry, but you're misinformed. Most states already have a database on controlled substances. Here's Kentucky's:

KASPER

Pharmacists, physicians, Medicaid, law enforcement and judges have access.

Indiana already monitors all Schedule II medication prescriptions to stop the practice of “doctor shopping”.

This while cheap heroin and meth flow over our southern border.

Catching smugglers is hard.

Attacking sick American citizens is easy but it makes them look like they are "doing something."

NC politicians are out of control.....dang. The Drug War is too costly and is giving Sheriff’s and DEA agents too much power... However once medical records are computerized I’m sure every tom, dick, and harry computer hacker or gov’t agency will be able to look at you’re full records. That way they can deny you coverage in Health Care......

And DU / liberals will be blaming us for this because we’re supposed to the law-and-order crowd.

I’m a conservative, but moving more libertarian by the day.
