US Attorney Says He's Ready to Retry Blagojevich

CHICAGO — U.S. Attorney Patrick Fitzgerald says the government is getting ready for a retrial against ex-Illinois Gov. Rod Blagojevich (blah-GOY'-uh-vich).

Fitzgerald spoke to reporters on Tuesday after a jury found Blagojevich guilty of one count of lying to federal agents. The judge declared a mistrial in the other 23 counts against him.

Fitzgerald thanked the jury for their service and said he didn't have any other comment.

Prosecutors had accused Blagojevich of trying to sell or trade President Barack Obama's former U.S. Senate seat among other allegations. Blagojevich had maintained that he did no wrongdoing.

Here’s the thing: How many Governors, Congressman or Senators have done /would the same exact thing as Blago did? Is it 90%, 95% ?

And I think that at some point the government has to stop retrying cases time after time. Not everyone is a billionaire to be able to match their money with top notch lawyers.

Actually, I’m all for taking it out of the Prosecutor’s pay/pension. There should be ZERO incentive for trying an innocent person and an overwhelming amount of “Proof.” The people being tried must sacrifice their lives and have nothing but their tarnished names and lost assets in a case. The Prosecutors should have their skin in the game. That would bring us MUCH closer to Justice, in our “Justice” system.

If you cost the taxpayers money, to pad your own pension, you should have to pay for it all as well. No more “Superstar” prosecutors. Ever.

While Blagojevich showed little emotion, his wife Patti seemed close to tears — shutting her eyes before the verdict and exhaling slowly to keep her composure. Just before the verdict, she pulled out two knitting needles and began working on what appeared to be a sweater.

Knitting needles? You can easily kill someone with those. Courthouse guards need to do a much better job.

Somebody explain “double jeopardy” to me, not the game show but the prohibition against being tried twice for the same crime.

Double jeopardy doesn't apply. It only applies if he were acquitted or if the charges were dismissed "with prejudice". Since it was a hung jury, the prosecution is free to retry him.

Okay, let’s do a 2fer, any political representative, government agent or political representative; including law enforcement, court member, regulators and those hired by government held to the same standard as forced upon the citizenry.

Once a verdict has been reached (guilty / not guilty), the defendant can not be tried again on the same charge / for the same incident/crime.

In this case, the jury could not decide guilt or innocence (hung jury) and the judge must delcare a mistrial. No double jeopardy as no verdict had been returned on the charges.

Yep. And I wish their sentence would be much harsher, additionally.

Recently someone was being arrested being taken into custody by an overzealous cop (Long story, but he didn’t like the attitude, granted the guy was a moron for saying he wasn’t going to blow anything up, when he should have said nothing, but still). Anyway, the thrust of my point is that when he was ebing taken into custody, his wife panicked, and tried to reach for him, and officers grabbed his wife. The man pulled away from police, and was allegedly charged with “assaulting an officer,” besides resisting arrest, etc, etc.

In any event, details of that story aside, of you assault some average joe, you may get say, a Class A misdemeanor (highest). But if you hit an officer, you get a 2nd Degree felony in most states. So if they have these extra protections because of their positions (Not just law enforcement, but our overseers), then they should be held to a higher degree of accountability.

I don’t believe in jail time (in general), because I’m tired of paying for a political war and funding political prisoners. So, I say we seize all of the assets, and ostracize the offenders you mentioned, (ie. “any political representative, government agent or political representative; including law enforcement, court member, regulators and those hired by government”), and banish them for life. Politicians and their underlings will sell us into slavery to pad their own pockets. They should pay in kind, in my opinion.

No one was ever meant to be a life long public “servant.” We are supposed to have elected Sherriff’s (The highest LEO in ANY County, and all land is in some county or another, except maybe D.C./Territories, but they’re not states) and Deputies, and they’re supposed to be voted out by the people, at the people’s discretion. Not held to Political whims by appointed police chiefs. Now should we be subject to any law outside Federal and State Constitutional limitations. The house needs to be cleaned in every branch, and Judicial is NOT excluded. We need to fix that problem, and NOW, no more judicial activism, no more Ruling elite, no more unaccountable “Representation.” We must get our heads on straight (as a people) and quit trading liberty for security and tossing away both.
