Blagojevich trial: Hearing about jury deadlock nears

People are assembling for a scheduled 11 a.m. hearing in which we expect to get more information on the jury's deadlock.

Robert Blagojevich walks in the 25th floor courtroom alongside his wife, Julie, and son, Alex. "Good morning," he says to the reporters assembling in the hall.

A few minutes later, the father and son Sam Adams walk in, all smiles. Sam Sr. is dressed in a tan three-piece suit.

There's a line of people running all the way down the hallway of the 25th floor. Some are members of the public, hoping to slip into the courtroom -- even though we don't know the content of the note.

Out on the sidewalk, camera crews line the barricades set up at the courthouse's Dearborn Street entrance. Police Supt. Jody Weis stops by to shake hands with a Chicago police office providing security outside.

Rod and Patti Blagojevich enter the building at around 10:55.

"Good luck. God bless you," Rod told the crowd.

The pair walks past a crowd into the elevators. A man in line leans over to tell Rod that two people in Peoria, including "Carly" said to say hi -- "especially to Patti."

Patti turns with recognition and says, "Oh."

Rod: "How old is Carly, 15?"

The ex-governor gives a gentle wave to the crowd and walks in without saying anything.

Rod -- who was called out in the trial for dropping thousands upon thousands of dollars on designer neckties -- is again wearing the same Copenhagen blue tie that he's worn time and time again throughout the proceedings.

In its first communication in eight days, Rod Blagojevich's jury leaves us with a cliffhanger.

The jurors say they're deadlocked on some counts, they've tried to come to consensus and cannot. They want direction.

Here's a few things to consider as we await an 11 a.m. hearing where jurors will answer the note sent from Judge James Zagel, which asks for clarification on their division.

• Jurors earlier this week had already asked for the day off on Friday.

• Jurors said they were divided on counts involving a "specific act."

• Jurors say they've gone beyond "reasonable attempts" to come together.

• Jurors said in their note: "they've tried as hard as they can and they can't go any farther," according to one defense lawyer.

• It was unclear the number of counts they couldn't decide on.

• Judge James Zagel can tell jurors to go back and keep trying. But he went out of his way Wednesday to note he believes the jury already has been working hard to reach a conclusion.

"The jury in my view is exceptionally disciplined ... I think they're very diligent."

Due to multiple requests, here's a separate post with the wording on the portion of the note from Rod Blagojevich jurors. U.S. District Judge James Zagel didn't make the entire note public, he only read one section of it:

"In a situation where jurors cannot agree on given counts what should the next logical step be? We have gone beyond reasonable attempts without rancor. We now ask for guidance."

Zagel replied by saying he needed more information on where they stood in their deliberations. He also told them they don't have to be unanimous on every count. A partial verdict is a possibility.

Separately, one defense lawyer said that jurors also indicated they couldn't reach a conclusion on counts involving a "specific act."

Unsurprisingly, we’re still waiting for the 11 a.m. hearing to begin.

We’re on “Zagel time,” reporters are joking.

There’s chatter in the courtroom while we wait. Rod and his lawyers are talking and occasionally there’s a loud roar of laughter from his packed defense table.

Sketch artists are furiously drawing.

Earlier, Rod got up from his chair, walked over to Patti and pecked her on the cheek.

She’s wearing a flowy, white and black blouse and a black skirt. She’s sitting in her same spot — where she was all trial long, in the front row. Her brother is sitting next to her, his arm stretched behind her on a black leather chair.

The door leading from the courtroom to the judge’s chamber has been ajar. Someone just shut it hard. And we wait.

Wouldn’t surprise me if 0 spent part of “birthday week” in Chicago meeting again(?) with Fitz, while the media focused on MO’s extravagant vacay in Spain.

This outcome was predicable. The prosecution wouldn’t want to present evidence that might indict other politicos..so they didn’t pull out all the stops. The jury is certain to contain some Obama voters who would never convict a Rat.

Update .. the judge has fashioned a response
which the jury will consider. They should
deliberate on the wire fraud count.

Apparently, they’ve only agreed on 2 counts,
22 remain open.

Wire fraud counts correspond to the racketeering
charge ..

I am not on that jury, but from what I read there were several witness’s Blago wanted called and was refused.

I woumdnt judge the man if his defense was harmed by a Judge who was afraid of the President.
My beliefe is that the only reason he got charged in the first place was because he wouldnt appooint valerie Jarrett for free.

No doubt he is guilty, but so are a lot of others in this case.

Isn’t it interesting how the WH usually requests that MSM respect the privacy of the first family while on vacation? In this case MO seemed to welcome the photo ops, with daughter in tow. A deliberate diversion?

The Blagojevich jury has reached a unanimous decision on only two of counts before them.

“Your Honor,” their note reads. “In response to your communication of 11 August, 2010, we’ve deliberated on all acts and counts with the exception of the wire fraud counts. We have reached unanimous agreement on two counts. We have been unable to agree on any of the remaining counts.”

Judge James Zagel wants to send jurors a note telling them to go back and deliberate on the ones they haven’t even talked about. There are 11 wire fraud counts, and they largely have to do with the Senate seat sale.

The judge proposed responding with a note that says, in part:

“You should deliberate on the wire fraud counts to the extent necessary to enable you to vote on those counts. We recognize that your stated inability to reach agreement on other counts may have established to your satisfaction that you would be similarly unable to reach unanimity on some or all of the wire fraud counts.

Nonetheless, a deliberative decision by you on each of those counts should be made, even if it is a decision that you cannot reach unanimity on any of those counts.”

Zagel has given attorneys 10 minutes to mull this over.

Sketchy details only, bottom of the hour radio 5-minute news.....it's just been revealed how many counts jury has agreed on....don't know how anyone knows this.....hope it's amplified on the top of the hour news.....I don't think jury has to agree on all counts....my personal opinion is that Blago is guilty on some counts and that this judge will be overruled on several of his decisions and there will be a new trial.

The 68-year-old (Judge James B. Zagel) is a Chicago native who graduated from the University of Chicago and got his law degree from Harvard. He became a prosecutor in the Cook County state’s attorney’s office and later chief of the criminal division of the Illinois attorney general’s office.

In that post, he appointed a budding young lawyer, Jayne Carr, as his top aide. She later became Jayne Carr Thompson, wife of former Illinois Gov. James R. Thompson.

Gov. Thompson picked Zagel to head the Illinois Department of Law Enforcement in his administration and eventually recommended him to President Ronald Reagan for a judgeship. He was appointed to the District Court bench in 1987.

WASHINGTON The Senate yesterday confirmed President Reagan’s nomination of James B. Zagel , the Illinois State Police Department director, to be a federal judge in Chicago.

Without debate, the Senate approved Zagel ‘s appointment to the bench of the U.S. District Court for Northern Illinois.

Zagel , 46, has headed the state law enforcement agency since 1980. Prior to that he was Revenue Department director in Gov. Thompson ‘s Cabinet.

When Zagel is sworn in as a judge, Thompson is expected to nominate Jeremy D. Margolis, now inspector general, to the top State Police post.

Groomed as an understudy to Zagel , Margolis has been a troubleshooter for Thompson since the governor created the inspector general job in part as a political foil to what turned out to be a short-circuited 1986 gubernatorial challenge by Illinois Attorney General Neil F. Hartigan.

Robert Cooley is a former mafia lawyer who worked with corrupt Illinois officials and judges. He turned state’s witness and he explains how the Chicago “Machine” still run by Alderman Ed Burke who “picks” the judges and controls the Chicago City Finance Committee and his wife corrupt Illinois Supreme Court Justice Ann Burke still are up to their ears in corrupt politics as usual. He talks how this cabal of corruption:

1- controls the media,
2-pays off the U S Attorney (former and probably still pays off his middle men, hired during this super corrupt era, who hide stuff from present US Attorney Patrick Fitzgerald so the only people prosecuted are fall guys like Blagojevic so as to take the heat off the real top dog crooks like:

2-his Lords, Chicago Mayor Richard M. and Cook Co. Commissioner John Daley (sons of former Mayor Richard J.), County Board Pres. John Stroger Jr. (son of former County Board Pres. John Stroger),
3-House Speaker Michael and his daughter Atty Gen. Lisa Madigan,
4-Alderman Ed (buddy of Fast Ed[dy] now convict Vrydoliak - both of them were leaders against African American Mayor Washington in the “cousel wars” 20 years ago) and IL. Supreme Court Justice Ann Burke,
5-former Sheriff (of Nottingham) Sheahan, and
6-State’s Attorney Richard (Gisbourne) Divine, as well as
7-other Lords such as former Sen. President Emil Jones and now his son Emil Jones Jr.

I agree, Blago is the only politico indicted because Fitz pulled the plug before O and Emmanuel went through with a deal with Blago. This may not be lost on the jury, he never actually completed the deal, that’s because of Fitz.
