Judge Henry Hudson of the United States District Court for the Eastern District of Virginia today denied the motion by the U.S. Department of Justice that Virginias challenge of the constitutionality of Obamacare be dismissed. Virginia Attorney General Ken Cuccinelli filed the challenge shortly after Congress completed action on the controversial measure that includes a provision requiring every American to purchase a government-approved health insurance program. Article III, Sec. 2, clause 2 (see below) says:
In all Cases affecting Ambassadors, other public Ministers and Consuls, and those in which a State shall be Party, the Supreme Court shall have original Jurisdiction.
Why did Bolton hear this lawsuit?

When we get Ms Kagan on the SC, the court will probably rule against us in a New York minute! I know she is replacing another liberal judge, but I don’t think he is nearly as liberal as Kagan is.
