I quite agree and could add a lot more. Even the confederacy realized that there were several, non-slavery related, common sense changes that should have been made *then* to the constitution, which they put into their confederate constitution. But those changes have never made it to the US constitution.

From the very start to today, we still haven’t figured out a good way to pay for the operations of the federal government. The Income Tax and FICA are already collapsing from their overhead.

Marbury v. Madison resulted in the imperial presidency feared by the founding fathers, because the president is now above the law, impeachment and conviction being almost impossible.

Abraham Lincoln gave us corporate civil rights, that sorely need to be distinguished from living human civil rights.

Both the Posse Comitatus and War Powers Acts need to be integrated into the constitution. As does a Balanced Budget and prohibition of federal largess to individuals amendments.

Term limits for everyone. And there are many more issues beyond that.

Yes I agree with you. That has been my fear all along. The republicans and many are crazy if they think it will all go back to normal if they take the house back.

This is exactly what O hopes and what he took that stimulus money for. 400 B can go around to buy back loyalty of many, many, 2012 voters.

Great post, and exactly a long the lines I have been posting for a long time. This was obvious to me back before the election. Actually, even if conservatives can get back one of the houses... let alone both O will still be in office for two more years.

Nearly certainly there will be the replacement of 1 or 2 members of SCOTUS. Yesterday I posted that even if our side gets the house, expect a media blitz much worse than what Bill ginned up to avoid conviction of his impeachment. Additionally, it will be much worse than was unleashed on America against Bush to get O in as president.

2010 is not as much a win as the signal to start a media blitz against America. Remember, they still have over 400B of the stimulus unspent. Where does anyone think that is going?

All along it was to keep the Dems in power and particularly O in the White house.

We may all believe that but, it is up to SCOTUS and the will of the American electorate to follow that line of thinking. First is the need to keep the voters with us. Second is to get a challenge before the court so they can rule on it.

For part one, the fickle electorate can be expected to stay behind a mandate to get rid of the plan for how long? 2? 3? 4? years. Meanwhile the the media and the dems unleash a campaign to go back to O and his plan. Remember, they still have 400B to spend from the stimulus money, which buys a bunch of media and puts a lot of money and "gifts" in the voters pockets.

So now the second part. Do you really think SCOTUS will get on any action at any time soon? Do you think we will stay at the "balance" we are at now, or O gets to put someone else on the court?

Your thoughts and reasoning now? Fact is, until it is ruled unconstitutional it is in effect and the wheels an 100+ admin departments and agency's are moving ahead with their own rules (LAW!) that they are tasked to set up. So in even 2 years there will be a mess to unwind, and no federal agency or department just "goes away".

Wrong. Neither SCOTUS, Congress nor the White House have the final say. The people have the final say as to how they are governed. Anyone who doubts this fact need only look to the Declaration of Independence where our Founding Fathers state the people have the right to alter or abolish the government and replace it with another government.

The Constitution doesn't allow any branch to determine unilaterally what is and is not Constitutional. The Constitution is an unambiguous document that does not suddenly change at the whim of any branch of government, unless the people give their consent. It specifically cites the powers granted to federal and state governments.

And even if they did retake both chambers, the GOP leadership seems just fine with maintaining the status-quo:

That’s appalling, but they’re only two men. If Republicans win Congress, enough phone calls and protests will make them vote for repeal.

So unless you can show me a couple of examples of the citizenry successfully doing that there is nothing more to talk about. That is a pure dream that can not be exercised in the reality of today's America.

You must either have a short memory or don't read history. Ever hear of Martin Luther King Jr and his successful Civil Rights movement? How about Ghandi and his success with civil disobedience in India against the British? Keep talking.
