Throughout her career, Ms. Kagan has placed her politics above the law. She has never been a judge, never tried a case before a jury and has practiced law for only three years. She is the least experienced nominee in the last half-century.
Graham:
“This president chose someone who is qualified, who has the experience and knowledge to serve on this court ... and understands the difference between being a liberal judge and a politician.”
But for a single Republican vote - Graham - this nomination would not have left the committee.

That’s the Senate Judiciary Committee recommendation — confirmation of the nomination still needs the majority vote of the entire Senate, but given that the Demagogues have a solid majority there’s no stopping her..... never was a chance to stop her confirmation, short of video of her committing heinous (in the eyes of liberals) crimes.... no, that would not have been enough, either. Leftists can get away with almost anything and still be embraced for the good of the ‘cause’....

How to Know the Supreme Court Confirmation Process Supreme Court Justices are nominated by the sitting President, but they must be approved by the Senate to get the job. After the official nomination by the President, the confirmation process begins. However, before the President officially nominates the candidate background checks, legal histories and opinions on key issues will be researched. This is often done to ensure confirmation as well as to guarantee that the nominee’s beliefs are aligned with the current administration.
Article II, Section 2 of US Constitution
Step 1
Submit the name(s) of Supreme Court nominees to Senate. The President formally presents the nominee’s name to the Senate, who then submits the nominee’s to the Senate Committee on the Judiciary.
Step 2
Submit names of Supreme Court nominees to the Federal Bureau of Investigation for a full background examination. Although there are no requirements for becoming a Supreme Court Justice, it has become customary to conduct a full background check on all Supreme Court nominees.
Step 3
Know that the nominee and other witnesses appear at a hearing held by the Committee on the Judiciary. During this hearing the nominee will be questioned by the Senators on the Committee and others qualified to assess the capabilities of the nominee will be invited to testify. The Committee may question the nominees and witnesses on any topic for any length of time.
Step 4
Be aware that the Committee on the Judiciary votes on whether the entire Senate should reject or confirm the President’s nominee. The Committee will often send the nomination to the floor for a vote even if it rejects a candidate, although there’s only one nominee that the Committee has rejected, Reagan nominee Robert Bork. It should also be noted that Justice Clarence Thomas received a split Committee vote and no recommendation, but received confirmation on the Senate floor.
Step 5
Learn that the Senate receives the Committee recommendation for a vote, or possible discussion. If the Senate has pressing questions about the candidate they can choose to send it back to the Committee for further testimony. If no questions arise, the Senate votes. A simple majority is all that is required for the nominee to be confirmed as a Supreme Court Justice.
Step 6
Filibuster against the nominee. If enough Senators want to prevent a nominee from receiving a vote they can filibuster, or stall the confirmation process. If this happens a three-fifths (3/5) majority vote is needed to stop the filibuster and confirm the nominee.
