What Is The Jones Act?
The Merchant Marine Act of 1920 is a United States Federal statute that regulates maritime commerce in U.S. waters and between U.S. ports. Section 27, also known as the Jones Act, deals with coastal shipping; and requires that all goods transported by water between U.S. ports be carried in U.S.-flag ships, constructed in the United States, owned by U.S. citizens, and crewed by U.S. citizens and U.S. permanent residents.

On the other hand, waivers of the Jones may be granted by the Administration in cases of national emergencies or in cases of strategic interest. It would appear the U.S. government's initial refusal to foreign help most likely stemmed from a mis-calculation of the scale and deepwater technological barriers for this unprecedented disaster, and/or perhaps ..... pride.
The analysis trotted out by the authors doesn’t make sense on the surface. According to them the U.S. is turning down help due to a maritime act called the Jones Act. This act is cited to require that all shipping between U.S. ports be performed by ships which are U.S. flagged and built.
They jump to the conclusion that this would preclude foreign built ships from participating in the cleanup.
Most cruise ships which dock in the U.S are foreign built and foreign flagged. They avoid the Jones Act by putting into a foreign port during the cruise. So foreign vessels put in to U.S. ports all the time.
I don’t understand how these authors contend that the Jones Act plays in the strategy for the oil cleanup. To me this looks like a hit piece on the Jones Act.

I believe Bush did waive it but a lefist sent me a WaPo op ed from 97 that showed the USA didn’t take most of the help

I’m sorry, I don’t believe Zer0, et al, have ever heard of the Jones Act, much less abide by it.
There is an environmental edict that doesn’t allow oil cleanup technologies unless it can remove all traces of the oil.
Apparently the skimmers used by the Dutch may leave a sheen on the water. Since not 100% of the oil is removed, no dice.
Zer0 has now relented and will allow that technology, 7 weeks too late.
The Jones Act has been waived before. It was waived under Dubya. You would think the “constitutional scholar” and sitting senator at the time would know that.

I’d like to suggest they refused help and didn’t burn the oil at the onset because of the cozy relationship between O’s associates and the dispersant manufacturer, NALCO.

And I'm going to take a wild guess that the simple fact that all 5 gulf states have Republican governors has absolutely nothing to do with the administration's foot dragging.
