The tax stamp comes from the 1934 NFA - which was ruled unconstitutional by a federal district court back in the day. SCOTUS said the District court ruling depended on an evidentiary finding that it (SCOTUS) could not make from the record in hand. That's the Miller case, since misinterpreted by Scalia to stand for the proposition that that 1934 NFA and 1968 GCA are presumptively constitutional.
