Defense attorneys for Maj. Nidal Malik Hasan, the Fort Hood psychiatrist charged in a deadly shooting spree here last fall, won a four-month delay Tuesday in a hearing that could lead to his court-martial.
Army Col. James Pohl ruled in favor of the defense, which said it had not received the documents it needed. Witnesses will be called starting Oct. 4.
We got what we wanted, retired Army Col. John P. Galligan, lead attorney for Hasan, said after the session.
Hasan is charged with 13 counts of premeditated murder and 32 counts of attempted premeditated murder in the Nov. 5 shooting at a Fort Hood deployment center. Hasan was also shot in the incident and is paralyzed from the chest down.
The 66-minute Article 32 evidentiary hearing began after Hasan rolled himself into the courtroom. He wore a standard-issue Army camouflage uniform. His face was expressionless.
Paralyzed and suffering from chronic problems that Galligan said include chills and sores, Hasan wrapped himself in a blanket from the neck down as the hearing began.
...Hasan spent five months in Brooke Army Medical Center, then was moved to Bell County Jail in Belton.
Galligan has objected to his client's jailing, saying he should be in a medical facility and isn't a flight risk.
Galligan and his defense team won the delay after contending they either hadn't seen or had little opportunity to review critical evidence.
Defense attorneys want to review the FBI ballistics study, which is being done in Quantico, Va. They also want a DNA analysis and a probe by Fort Hood's Criminal Investigation Division, which also haven't been completed.
...Pohl's job is to weigh evidence and then make a recommendation on whether to proceed with a trial. That decision ultimately will rest in the hands of higher commanders.

Just call them in one by one and that’s the end of it. Let the jury call them all liars if that’s what they want to do, but that’s all the evidence needed here.
The man entered an area where weapons were not to be. He planed to do it. He carried it out. He killed 13 people.
This guy should be swinging in the breeze long before now.
To my way of thinking, this makes the U.S. look like a paper tiger. Justice delayed is not justice. Those 13 dead military personnel, their families, and friends, in fact the nation at large deserves better than this.
This sickening display for all to see is destructive.

I’m not up on the protocol here so..... why was this murdering muslim savage allowed anywhere near, or worse, to wear again the Army uniform of our great country? was it in the past, or is it still, just sop in these instances? more muslim pc pandering crap possibly? both?
