Washington state...where governors are allowed to STEAL elections, but cell phones are evil.
Yea, it’s a Motorola device that clips to the sunvisor. I find it more distracting and less responsive than just pushing the “press to talk” button on the phone.
And of course, they’re going to take away the cell phones the officers spend their whole shift yakking into as they cruise their beats, right? No? Then they don’t get to take the phones belonging to citizens. I’m ok with restricting cell use in active school zones, and with banning texting while driving, and with increased penalties for drivers who cause accidents due to cell use, but some of us are capable of operating a cell while driving and being perfectly safe about it (because we can keep priorities straight, like driving comes first).

The guy who almost hit me this morning sat there and looked at me while I was honking at him to quit drifting into my lane was holding a cell phone up to his ear and talking on it. The driver of the truck hauling a load of bricks that almost went off the road a couple miles farther down the road was sitting there texting. I could see both plainly doing so and I was driving at 65+mph.
On many occasions I will speed up to get around people yakking on their phones when I can-this morning I was in rush hour traffic which made that a bit harder to do. They are easy to spot-they break lane and weave about the road worse then drunk drivers do and in almost all of the cases you can see them plainly holding a phone up to their ear. I would rather have them way behind me then in front of me-that way they will hopefully only kill or maim themselves.
The problem I have with this is that talking on a ham radio is the same as talking on a phone and Hams have been driving and talking on radios since they invented radios.
If you are talking to someone in the car, it is no different than talking on a phone. The only thing I see that can cause accidents about a cell phone is texting while driving. It takes more than one hand to do it and it takes more concentration than talking. Bad law, put into place to enhance revenue. It hasn’t worked well in CA and I see no reason why it will work in any other state.

Maybe because they are driving 45 in a 65 zone, and wandering across all the lanes?
My recollection is that there's a specific exemption in the law for situations where a person is involved in an emergency communication with law enforcement.

The offense is classified as an infraction, so the quantum of proof is only by a preponderance. Also, since it isn’t criminal, the defendant can be called and compelled to testify at the hearing. And if you request a contested hearing, the defendant must subpoena the officer or the ticket is just read into the record. Guilty (or more correctly, Committed). It’s all about revenue and cheap operation of the system.
What if I’m in my Toyota and the accelerator gets stuck and I have to call 9-1-1? (hee hee)
Are you legally obligated to show them your call log? It lists the ph#, date and time of each call. :D

Beg to differ. Half-duplex P-T-T mikes with speakers are very different from cellphones held to the ear -- or even hands-free headsets. They still have a tendency to distraction but nothing like the full-duplex communications offered by cellphones. (I don't know where ham radio is these days, do you have full-duplex comms?)
I don't know, but from time to time I see police strategically located by the entrance to a freeway on-ramp, staring into every car that passes by, with other police pulling ID'd cars over. Having driven through "the stare" it's pretty clear they're looking for people not wearing their seatbelts.

Maybe they are hoping the people dont have time to fight them in court.
