Elena Kagan, the President’s pick to replace retiring Supreme Court Justice John Paul Stevens, is an affable and intelligent Trojan horse.

Obama’s high court nominee has been groomed for years, standing ready for the judicial mission of advancing the secular-progressive agenda, if confirmed, for decades to come.

Conservatives can (and must!) build a coalition to defeat Kagan’s nomination.

Can the Right focus on what little public record Kagan has created and stop dealing in conspiracy theories that Kagan is some sort of sleeper agent,having been groomed since college for this position. If the other side’s efforts are that good and that well planned than how did W ever win and place Roberts and Alito on the Court? I sometimes think conservative bloggers fear the conspiratorial abilities of the Left the way Grant felt Army of the Potomac officers believed Lee could do a double somersault with his army and attack both flanks and the rear simultaneously. They’re not that good.

From today's NY Times article: "As a scholar, Ms. Kagan’s interests were narrow, somewhat technical, and steered clear of ideology. She was interested in questions like when the government could limit free speech. “This is not a subject about which there is any ideological slant,” Mr. Stone said. “It’s an intellectual puzzle.” "

Well except for some obvious cases like stating classified information, or inciting to riot, or shouting fire in a crowded theater or other downright fraudulent things that create obvious danger, or slander, the issue is an ideological issue with liberals wanting to ban all sorts of things.

She's a New York liberal Democrat. You don't need to review a “record,” she is who she is. It doesn't matter that she's pleasant, gave Scalia a dinner or has been civil to conservatives. She would be 100% pro abortion, period. And she would be an anti-Originalist, “living Constitution” type. I concede she might turn out like Breyer to vote with conservatives on some business cases, but also like Breyer she would go left on the big questions.

In her favor: Nothing in the Constitution says a Supreme Court Justice has to have been a judge before or a lawyer for that matter. Oh, and who she knows.

Not in her favor: She has never served on an appellate court or any court of original jurisdiction. She has been Solicitor General for one year and has never argued a case before the Supreme Court. She was a law professor and dean of a law school ... but a mediocre/average one cause she never written any scholarly document.

Sounds as though this nomination must be filibustered and defeated or her personal opinion (and not legality/constitutionality) will be legislated from the bench.
