IRS to Serve as Health Reform Enforcer, but Lacks Authority to Enforce

The health care reform bill to be signed Tuesday by President Obama would give the IRS a new mandate to enforce some of the initiative's key provisions — but apparently not the means to do so.

Under the Senate bill approved Sunday by the House, the Internal Revenue Service would be called on to ensure Americans are obtaining health care insurance and businesses are offering it, or else they could face fines. Many would receive subsidies to help pay for insurance.

It will cost the IRS $5 billion to $10 billion over 10 years to handle the new workload, according to a March 11 estimate by the Congressional Budget Office. But the Senate bill doesn’t provide any funding for the expansion of the IRS, and it virtually ties the hands of the IRS to collect fees on individuals and businesses who don’t buy health insurance.

“The use of liens and seizures otherwise authorized for collection of taxes does not apply to the collection of this penalty," according to the non-partisan Joint Committee on Taxation. "Non-compliance with the personal responsibility requirement to have health coverage is not subject to criminal or civil penalties under the code and interest does not accrue for failure to pay such assessments in a timely manner."

The Rats weren't as smart as they thought. If you have a zero return (which is something we should be shooting for anyway), they can't collect if you don't buy an "approved policy".

If it’s a mandate to enforce...Can’t the next President..(Hopefully a Conservative Republican)...Kill this thing by not allowing the IRS the funding to follow through with enforcing these laws? I hope I hear more Republican Senators stand up and talk about repealing this..so far i’ve only heard DeMint. But if Republicans take Congress maybe if they won’t repeal right away.....they should defund some of the programs and issue different guidlines to the bureacracy. Congress has partial control over some of the Agencies of the Executive Branch....

Keep the pressure on both the House and Senate not to fund this project.

After November, it will be a lot easier to do this.

The next Congress can defund every single item in the whole bill, effectively preventing enforcement of the bill. It doesn’t solve the problem, but it does lessen the impact on the economy.

Well, you could try to withhold less, keep more of your money in order not to get a refund from which they can siphon off the fine, but even if you have a balance due, they can add the fine to that balance. You could refuse to pay it, I suppose. Then, can they enforce it? If not, are you audited?

However, with one caveat - they no longer need to leave the office to enforce the laws; all it takes is to electronically freeze your bank account or transfer funds.

And don’t think it isn’t going to happen if this scheme isn’t overturned.

Just because the Legislature appropriates money for the hiring of IRS agents does not mean that the Executive Branch has to hire them. The power to enforce the law is granted solely to the Executive Branch. Congress cannot force the President to do squat.

This is the forgotten power. Any President can balance the budget by refusing to spend the deficit spending sent to him. Congress appropriates $100 billion in highway funds. The DOT sits and does nothing while the $100 billion sits in the Treasury.

IN the state of New Jersey, 18% of every health insurance dollar goes towards administration and 7% to insurance co profit.

NJ has the most efficient health insurance administration in the United States due to the effects of some mixed bag of reforms under the Gov Florio administration.

Not all of the 18% goes toward additions/changes/terminations of coverage of course, but a fairly large amount of it does.

Private health insurance companies now in a monopoly or oligarchy position will pass on the added costs of compliance with the IRS on to the trapped serfs, i mean consumers. Which is going to cause untold disasters because the dealys between filing for additions/changes/terminations and the time the insurance companies actually process the paperwork is already running into several weeks on average.

Now when there are mistakes, the IRS will be flagged, which will open a file on the individual and corporation which can and will lead to BOHICA audits. This is especially egregious when companies are in downward spirals and shedding staffing to survive. Also when a person is dislocated from a job for whatever reason, they will be additionally hounded by the IRS during their period of unemployment. I have not seen the mechanism for newly unemployed to file for health insurance subsidies at the same time the sign up for unemployment benefits. U/E benefits are run by states, the healthcare mandate is Federal.

I’m also fearing a new crime under the Fair Labor Standards Act , “conspiracy to deny health insurance premium compensation” if companies start 1099’ing all employees. Already plenty of cases about employers denying health insurance and insurance premiums to employees. This will expand drastically if ACORN and the DoJ under Obama get the time to push for it.

I remember it well. At some point, these IRS stooges will be re-organized into a different gov't agency that morphs into the brownshirts.

The analogies are scary. Domestic Police Force = Gestapo/Brownshirts; The need for an enemy: Big business of the day = Jews; Gibbs = Goebbels; Disregard the US Constitution = disregard the Weimar Constitution; Gov't paid summer jobs for kids = Hitler's Youth; "Hope and Change" = "Third Reich", ...

If the Republicans were smart they would run on ABOLITION OF THE IRS, come November they would WIN EVERY SINGLE RACE. But they won’t do anything. Looks like it is up to the States.

At some point in time, the army gives up. Either they see the millions they are up against, or they realize the immorality of fighting its own citizens. Even the mighty Soviet Red Army could not fire on its citizens.

Armies need clear goals to be motivated and effective. The Pygmallion Effect, used very effectively in today's military for motivation and accountability, would not be effective in the Obama Army. Citizens with guns cream the Obama Army in any hypothetical battle.
