'Deep Tort' Says Wednesday Is the Day for Slaughter Solution

Blogger Doug Ross is well-wired on K Street and has been pumping a senior executive - dubbed "Deep Tort" - for a major lobbying firm for updates on the situation in the House regarding Obamacare votes.

Deep Tort says Wednesday looks most likely as the day for bringing the Obamacare package to the House floor, via the Slaughter Solution rule, though he cautions that House Speaker Nancy Pelosi still has other options available if needed:

"The budget committee is all smoke and mirrors. They are required to pass out a budget reconciliation bill in order to start the process. They just dressed up an old version of the House bill in reconciliation clothes so Pelosi and the rules committee have a vehicle they can completely amend with their own reconciliation instructions.

"Likely Wednesday, the rules committee will report a rule which essentially does 3 things. 1) sets the time for debate; 2) makes 1 substitute amendment in order; and 3) deems the Senate bill passed.

"The House will proceed on 3 votes on health care.

"1) approval of the rule (this will be the big vote since it passes the Senate bill by default)

"2) approval of the leadership/rules Amendment in the nature of the substitute (strip the budget committee text with the leadership text)

" 3) final passage."

Unless the Republicans can stop this charade, they should

BOYCOTT all House proceedings

while the Democrats attempt to undermine the Constitution with this charade, in order to draw attention to a sleeping country.

part of me hopes that they do go the Slaughter route, as it will throw the door wide open for Constitutional challenges in court.

No, it doesn't. The bill did not pass by a vote of Congress. It is therefore NOT law.

I get really tired of people acceding to the legitimacy of this process in speech.

...I thought reconciliation was under handed....this...by far....is as low as one can go...

Honestly...I really don't believe the House Dem's have the stomach or stones for this....

IMHO.....they will take the reconciliation road....than try the same with Amnesty.....and pray the public forgets come November....

For some reason I don't think the courts have jurisdiction over legislative process.

Kristinn, do you think there are enough State Attorneys General out there with enough guts to file an immediate lawsuit over this if they pass it?? It’s the only way I see of stopping it before it does unrecoverable damage, and if the Courts weigh in this thing is toast...

It will come down to whoever the courts deem have ‘standing’ and whether a TRO can be obtained. I’m not sure the health care bills have state mandates.

I think Barry was making a preemptive strike when he attacked the Court. Now he can say that they are biased against him (since he, after all, gave them cause for anger) and that therefore they can’t hear anything affecting him. And if they can’t, who can? Or will he get to appoint his own justices for this?

I don’t think it’s safe to assume that the Court is going to be able to handle this.

In a 1998 Supreme Court ruling, the high court stated that a bill with the same text must be voted on and passed by BOTH houses of Congress in order for the bill to become law.

Mark Tapscott has another piece at the Washington Examiner this morning about Pelosi and Slaughter filing amicus briefs against a Republican effort to do the same thing in 2005 with the debt limit.

He doesn't say how the case was resolved.
