Justices signal end to Chicago ban on handguns

Most of the Supreme Court justices who two years ago said the 2nd Amendment protects individual gun rights signaled during arguments today they are ready to extend this right nationwide and to use it to strike down some state and local gun regulations.

I find it amusing, the pro-gun side is very cautious, while the anti-gun side is freaking out. I think we’ll get more than we expect, less than we want and the anti’s will be shocked at what comes next.

The reason the Second Amendment DOES apply to the states is simple: The TEXT of the Second Amendment. Unlike the First Amendment, the Second Amendment doesn’t say “Congress shall make no law” or anything resembling that.

Even without the bogus “incorporation doctrine,” the Second Amendment applies to ALL levels of government.

Just an observation that the gun laws in Chicago don’t seem to make any difference. The well armed youth gangs have turned vast areas of that city into a war zone. Some of the gangs have better weapons than the police.

As far as our 2nd amendment rights are concerned, I always thought the plain language of the 2nd amendment was pretty clear. If the Supreme Court reinforces the meaning that is plainly spelled out, it will help set good legal precedents, and strike a blow for common sense. The liberals have used pretzel logic to try to tell us that the 2nd amendment doesn’t really mean what it says. And that pretzel logic is what’s behind such laws as Chicago’s handgun ban, which as noted, is ignored by the gangs anyway.

Two children died last week in what officials describe as homicides stemming from child abuse.

On Friday, a 2-year-old boy died after he experienced trauma to his head and abdomen, according to information from the Cook County Medical Examiner’s Office. The child was being cared for at a home in Portage Park, police said.

Also Friday, police said they discovered a newborn girl, who had been wrapped a plastic bag and placed in the closet of her home in the 6100 block of North Sheridan Road. Charges have been brought in both cases.

Citywide, 17 homicides have been recorded so far this month. Chicago police recorded 25 homicides in February last year, a RedEye analysis of preliminary police data found.

West Garfield Park and Morgan Park each saw a fatal shooting in the last week.

On Monday, a 25-year-old man was shot to death in the 4300 block of West Flournoy Street. A 20-year-old man was shot to death on Saturday in the 11200 block of South Hermosa Avenue, according to police information.

This is the first homicide of the year for both West Garfield Park and Morgan Park, a RedEye analysis of preliminary police information found.

Citywide, 11 homicides have been recorded so far this month. Chicago police recorded 25 homicides in February last year, RedEye found.

A 33-year-old man was shot to death in Washington Park, a 30-year-old man was shot to death in Auburn Gresham, and a 25-year-old man was strangled and beaten in South Lawndale, police said.

That the ban will end is a given. Only question here is “how”, and the way the Supreme Court worded the question belies a desire on their part to use this case as a means to address/restore the “privileges and immunities” clause.

If Kennedy votes to overturn the Chicago gun ban and that the 2nd Amendment applies to state, he clearly deserves the award for “Most Improved Supreme Court Justice”.

He has really come around in recent years voting to uphold the ban on partial birth abortions and overturning campaign finance laws.

I wonder if he might be ready to vote with Thomas, Scalia, Roberts and Alito to overturn Roe v. Wade?

Justices are not permitted to answer questions that are not asked ... they are deciding an individual case, not crafting legislation about the limitations of the Second amendment. The right to carry is not what the case is about. Further questions must be answered in further cases.
