Packing the court makes sense,

I don't think so at all. When FDR tried to pack the court, it was because the Court had repeatedly struck down parts of his New Deal. This Court hasn't done that. Really, it hasn't been hostile to the administration at all--it hasn't had time to be--Obama has only been in office for a year; it's just been more conservative than, presumably, the administration would like.

It would be seen for what it is: a naked power grab, and people don't like that. It would be a dumb move.

This guy was wined and dined by some mid-level White House staffer, who probably promised a audience with the president.

This is obamas first "float" of this plan, they will push for it, until we (America) as a whole push back.

On the contrary he should reduce the court to 5. Keep Roberts, Thomas, Scalia and Alito. Ditch 4 of the remaining 5.

There’s also something about tradition you don’t mess with willy-nilly. Nine justices has been the law since 1869. That’s worked out relatively well for almost a century and a half.

We could change a lot of things that aren’t explicitly in the Constitution, but at what political cost, and for what political motivation?

This is raw, naked politics. The Left doesn’t like Scalia, Thomas, Roberts and Alito, so this is their plan. They fail to understand that the Right is equally displeased with Ginsburg, Stevens, Bryer, and Sotomayor. Should we be allowed to pack the court to lessen their influence?

The Leftist will say absolutely not, those are the good judges! Oh contrare, says the Right, Thomas, Scalia, Roberts and Alito are the good guys! And so then it comes down to the truth; whose ox is being gored... This Leftist writer should be ashamed of himself. It’s just politics. No place for the rule of law.

Fail.

Yep, it's "Calvinball" as government. Naturally, they'll try to limit the size of the court immediately *after* tipping it in their favor, to prevent the same tactics from being used against them.

The court packing scheme didn't work out well for FDR.

That's because several members retired and he was able to replace them with his own appointees, keeping the original number.

Upon almost exactly this question in Marbury v. Madison was the original doctrine of judicial review by the USSC first built! An attempt to pack the courts with last minute appointments.

Obama should just declare himself “Supreme Ruler” or “King of the US” and skip all this fancy “court packing” nonsense.

I have another idea. Constitution allows the Federal judiciary to be reduced to a Supreme Court and one person. It should be done with Scalia or Thomas as Chief Justice of the United States. Give him a few hundred million for staff. Let him spend the rest of his life overturning the laws we have.

OK increase the number of justices - pass the law.

but...Obama doesn’t get to pick them.

The next time the opposing party gets elected THEY get to appoint them.

That way no party will ever want to do it.
