SAN FRANCISCO -- In a case that reached the U.S. Supreme Court, a Bay Area woman has won the right to parental status and visits with the daughter of her former lesbian partner, who moved out when the girl was 3 months old.
The high court denied review Monday of an appeal by the birth mother, identified only as Kristina S., who challenged her former partner's right to be considered a parent. Kristina's lawyers, from the religious conservative group Liberty Counsel, argued that recognizing parental status after a few months of care violated a mother's right to control her child's upbringing.
The court left intact a June 2009 ruling by a state appeals court in San Francisco that said Kristina's partner, identified as Charisma R., had been fully involved in conceiving and taking care of the child and was legally her co-parent. The ruling also allows her to argue for reimbursement of the costs of traveling to Texas, where Kristina lives with their now 6-year-old daughter, Amalia.
"I love my daughter dearly, and I am relieved the courts have recognized that children born to same-sex couples deserve the emotional, financial and physical support of both their parents," Charisma said in a statement released by her lawyers at the National Center for Lesbian Rights.
The ruling shows that California courts will protect both members of a same-sex couple who decide to have a child together, "even if they break up when the child is young," Cathy Sakimura, one of Charisma's attorneys, said Tuesday.
She said Charisma, who was not allowed to see the child for five years, began visiting her last year under an Alameda County judge's order. The couple had lived in Newark, and Charisma now lives in Santa Clara County, Sakimura said.

You got it. IF I had been in a homo/or lesbian relationship and now am straight & wants nothing more to do with this perverted lifestyle, I would rather go on the run with my natural born child, rather than be forced by a corrupted, immoral, reprobate court system to turn my child over to a homo/or lesbian for unsupervised, overnight visits. And then to be FORCED to pay for the former homo/ or lesbian travel expenses. I would never submit to that.
