Sauce for the goose is sauce for the gander. If our civilian rules of evidence and discovery work for Mafia trials and drug cartel trials, then they’ll probably work for Islamic Jihadist trials. And if those rules don’t work, then maybe their failure will induce us to try to improve our judicial system by writing a few new rules. And if our civilian rules of evidence and discovery don’t work in the KSM trial, and we don’t learn and grow from the experience, then we deserve that which will likely follow.
What you describe here is, from my point of view, and I write from deep in the Islamic world, sheer insanity.
