What kind of lawyer is this? Why they did it is irrelevant to the determination of guilt (unless, of course, they are arguing insanity of self-defense - not the case here). Any decent judge would rule it irrelevant. The issue at trial is if they did it, which they admit to. Get on to the penalty phase.
