One trial down, one restraining order to go.
Less than two weeks after state Sen. Hiram Monserrate was convicted of assaulting Karla Giraldo, she's asking a judge to lift an order of protection that has kept the couple apart for more than 10 months.
Monserrate's lawyer had announced after the verdict that the separated lovebirds plan to marry, but a wedding would be impossible without the order being vacated.
Giraldo's lawyer, Glenn Marshall, wrote to state Supreme Court Justice William Erlbaum, who in a bench trial convicted Monserrate of reckless assault, saying the couple wishes to resume their "intimate relationship . . . without further unnecessary interruption or delay." Erlbaum is set to sentence Monserrate in December.
Marshall noted that the basis for imposing the order -- the charge that Monserrate intentionally injured Giraldo with a glass -- had been decided in the freshman Democrat's favor during the trial.
"Furthermore, given the intense level of public scrutiny which currently surrounds Sen. Monserrate, there is no realistic danger that he will cause future injury to Ms. Giraldo," Marshall wrote.

Either he's guilty, and she's a moron for being willing to marry a violent and abusive man, or he's innocent and he's the moron for being willing to marry a woman who makes false accusations. There is no plausible situation in which it makes sense for these two to marry.

Well, I don’t like reading about women being shredded in the news. If she initiated an action that lead a judge to issue a restraining order, then I see no reason to allow her to call “backsies” now.
Not the government’s job to think for her.
And by the way, it's a cost-cutting measure. How much is it going to cost the City of New York to constantly be sending police and emergency personnel over there. Lets save those services for people who really need it.

Well, that's a good point.
She needs to be sterilized before she is turned loose onto the streets.
