Our Unconstitutional Census

California could get nine House seats it doesn’t deserve because illegal aliens will be counted in 2010.

Next year’s census will determine the apportionment of House members and Electoral College votes for each state. To accomplish these vital constitutional purposes, the enumeration should count only citizens and persons who are legal, permanent residents. But it won’t.

Instead, the U.S. Census Bureau is set to count all persons physically present in the country—including large numbers who are here illegally.

The result will unconstitutionally increase the number of representatives in some states and deprive some other states of their rightful political representation. Citizens of “loser” states should be outraged. Yet few are even aware of what’s going on.

In 1790, the first Census Act provided that the enumeration of that year would count “inhabitants” and “distinguish” various subgroups by age, sex, status as free persons, etc. Inhabitant was a term with a well-defined meaning that encompassed, as the Oxford English Dictionary expressed it, one who “is a bona fide member of a State, subject to all the requisitions of its laws, and entitled to all the privileges which they confer.”

Thus early census questionnaires generally asked a question that got at the issue of citizenship or permanent resident status, e.g., “what state or foreign country were you born in?” or whether an individual who said he was foreign-born was naturalized.

Over the years, however, Congress and the Census Bureau have added inquiries that have little or nothing to do with census’s constitutional purpose.

Dumb question: Why not use the number of registered voters (instead of the census) to determine the correct number of Representatives? (Other than for constitutional reasons, I mean.)

Well US citizens who are unregistered or do not vote must be included because the elected representatives act on behalf of all: voters, non-voters, and unregistered US citizens.

It says persons in the Constitution. Nothing about citizens. The “excluding Indians not taxed” part could apply, in concept, to illegals. The spirit of the document suggests it IMO. Nine more California reps sounds like a nightmare. No offense to Californians meant.

Everyone's entitled to dream I suppose. But the way things are going, It's not likely that Obama is going to allow elections in 2012. He doesn't obey laws now, why would he start then?

You folks know who is slated to organize, shape and run the 2010 Census?

His first name is Rahm.

They are going to rig the system. Guarantee it.

Rahm Emanuel (and Barack Obama) believe in a modeling process that makes an assumption that in certain areas, for every person you see, there are a number that you don’t see, and they are going to make an assumption and count them.

So, in certain areas, they might multiply the actual count by 1.2, 2 or three. (I don’t know what the number is, if it changes by area or is consistent)

They are going to rig the system. And they will do it ‘legally’ because...they will simply change the law or interpret it their way.

The campaign by the Mexican American Legal Defense and Educational Fund in Chicago — including Spanish and English fliers and door-to-door visits — is one among several advocacy groups nationwide working to ensure minorities are accurately counted.

“This is one of the most important civil rights issues,” said Elisa Alfonso, a director of the group’s Midwest office in Chicago. “This is what gives you access to voting and funding.”

The states involved in the program are Illinois, Indiana, Michigan, Ohio, Wisconsin, Missouri, Iowa, Minnesota, North Dakota, South Dakota and Nebraska. Similar efforts are planned for other U.S. regions later this year.

The census, which is mandated by the U.S. Constitution every ten years, asks questions about race, age, gender and the number of people living in each household. It is used to decide how hundreds of billions of dollars in federal funds are distributed and how congressional districts are drawn.

Still, challenges exist in reaching out to Latinos, Alfonso said. Some immigrants are wary of providing detailed personal information to the government because they fear doing so could lead to inquiries on Immigration status for themselves or family members.

The Census does not ask about Immigration status or citizenship.

“The Census Bureau is sending out messages, but it’s still a government organization and you have people who are distrustful of it,” she said.

In its campaign, the Mexican American Legal Defense and Educational Fund is stressing the confidentiality of the data and encouraging people to mail back completed forms early. Their slogan for the effort is “Hagase Contar,” or “Make Yourself Count.”

Under this administration, do you really think the number of individuals will be a consideration? ACORN will not count people, only provide a listing of numbers and they will have no relationship to the actual number of residents.

The first census to list everyone and give his or her place of birth was 1850. Before that they had heads of households and broke the male and female populations down by age groups (different for free persons than for slaves). I have looked at a number of pre-1850 censuses and don't recall anywhere that a person's citizenship status would have been indicated.

The 14th amendment specifies that "Representatives shall be apportioned among the several States according to their respective numbers, counting the whole number of persons in each State, excluding Indians not taxed."

So persons present illegally have to be counted. The danger is that non-existent people will be counted by ACORN. Add several tens of thousands of made-up people with typical Hispanic names to each big city (along with made-up African American, Asian American, and African names) and tip some Congressional seats and electoral votes to the Democratic side.
