Sotomayor Reverses Herself on Use of Foreign Law

During Judge Sotomayor’s public Senate confirmation, she was asked if she would use foreign laws to interpret American laws. The question, asked by Senator Coburn, arose from Judge Sotomayor having repeated stated in the past that she approved of the use of foreign laws to interpret the American constitution, particularly the fifth, eighth, and fourteenth amendments.

Judge Sotomayor’s answer to Senator Coburn was

I will not use foreign law to interpret the Constitution or American statutes. I will use American law, constitutional law to interpret those laws except in the situations where American law directs the court.”

P-p-p-perjury??? In a nominee for the Supreme Court?

If this is true, it should be grounds for instant disqualification.

what law she would or would not use is not perjury hello, it’s confusion of mind

this little lady is too dumb to be on the Supremes, she would go with whatever she heard last or whatever TV show she saw last night

I know only this. If either of my two senators vote to confirm this witch I will do everything in my power to remove that person from office next time around!

To me, the issue is not whether a judge considers events or laws abroad in positing ideas; hell, the founders of the Constitution did so in drafting it! One would almost expect a justice to cite bad foreign examples as contrasted to the American system. Judges may not however, cite foreign legislation or case law as authoritative.

This issue is about a deliberate attempt to mislead under oath for purposes of political cover. In this instance, IMO, Judge Sotomayor should not only be disqualified, but disbarred.

A mediocrity. She gets away with being mediocre because she was an affirmative action admission to a first tier school. And since this school has diluted the value of their degree with affirmative action mediocrities, the question becomes - hasn’t the school itself become a mediocrity since its degrees no longer mean what they used to mean?

I concur with that entirely.

I put a great deal of blame on the gutless cowards who serve in congress as well. If they were doing their jobs, any federal judge anywhere who cited foreign law as a basis for their opinion any any case would have impeachment proceedings started againt them the next day!

Must be nice to know you can sit in front of a Senate committee and blatantly perjure yourself without fear.

Of course, the majority of members of that group can’t handle the truth anyway. So maybe the Wise Latina is onto something after all.
